FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to the use and registration of prawn and other nets and

eel trapping)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 16th October, 1992.

Amendments

2. The Fisheries and Oyster Farms (Nets and Other Fishing Gear)

Regulation 1989 is amended:

(a)

by omitting from clause 8 (23) (a) the word “full” where secondly occurring and by inserting instead the word “new”;

(b) by omitting from clause 11 the words “otter trawl net (prawns)”;

(c)

by omitting from clause 13 (1) the word “shall” and by inserting instead the word “may”;

(d)

by inserting in clause 58 (1) after the word “lawful” the words “for a licensed fisherman”;

(e)

by omitting from clause 58 (1) (a) the word “A” and by inserting instead the word “The”.

EXPLANATORY NOTE

The objects of this Regulation are:

(a) to more accurately describe the period (“the dark”) during which a prawn net (set pocket) may be used in the Clarence River on weekends;
(b) to omit otter trawl nets (prawns) from the classes of nets that are required to be registered;
(c) to confer on the Director of NSW Fisheries a discretion to decline to register a net even if an application to register the net is duly made and the net may lawfully be used, in place of the requirement that the Director must register the net in such circumstances; and
(d) to provide that only licensed fishermen (and not also recreational fishermen, as at present) may use a trap for taking eels in waters specified in the Table to clause 58.
