FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to the supply of trout)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (General) Regulation 1989 is amended

by inserting at the end of clause 37 the following subclause:

(2) This clause does not apply to the delivery or consignment for sale of trout propagated, hatched or reared by the holder of a permit to operate a fish farm issued under section 90C of the Act.

EXPLANATORY NOTE

Clause 37 currently prohibits the delivery or consignment of fish for sale which have been mutilated in any manner other than by gutting or removing the gills. The object of this Regulation is to permit the processing of trout before it is delivered or consigned for sale by providing that the prohibition under clause 37 does not apply to the delivery or consignment of trout propagated, hatched or reared by the holder of a permit to operate a fish farm.
