FISHERIES AND OYSTER FARMS ACT 1935—REGULATION
(Relating to the prescribed methods of taking yabby, squirt worms and other
intertidal invertebrates)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (Nets and Other Fishing Gear) Regulation 1989 is amended by omitting clause 45A (a) and by inserting instead the following paragraphs:
| (a) | a pump or similar device having a barrel or cylinder with a diameter of not more than 85 mm; or |
(a1) a tube or cylinder (whether or not fitted with a cap at one end) with a length of not more than 250 mm and a diameter of not more than 85 mm; or
EXPLANATORY NOTE
The object of this Regulation is to amend the Fisheries and Oyster Farms (Nets and Other Fishing Gear) Regulation 1989 to make it clear that it is permissible to take yabby, squirt worms, blood worms and other intertidal invertebrates from any place other than a rock platform by use of:
(a)
a pump or similar device of any length (but with a diameter of not more than 85 mm); or

(b)
a tube or cylinder (with a length of not more than 250 mm and a diameter of not more than 85 mm).
This Regulation is made under the Fisheries and Oyster Farms Act 1935,
including section 120 (2) (f) and (g).
