FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to the cleanliness of containers, boats and vehicles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 24 September 1993.

Amendment

2. The Fish Marketing Regulation 1980 is amended by inserting after

clause 37 the following Part:

PART 4—GENERAL

Cleanliness of containers, boats and vehicles

38. A fisherman must not store or transport fish for sale in a container or in any part of a boat or vehicle unless the container or that part of the boat or vehicle is clean and free from any matter likely to contaminate the fish.

Maximum penalty: 50 penalty units.

EXPLANATORY NOTE

The object of this Regulation is to amend the Fish Marketing Regulation 980 to
provide that licensed fishermen must not store or transport fish intended for sale in
an unclean container or in any part of a boat or vehicle that is unclean or has
Contaminants present .

This Regulation is made under section 120 (the general regulation making

power) of the Fisheries and Oyster Farms Act 1935.
