FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to nets for taking prawns)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (Nets and Other Fishing Gear)

Regulation 1989 is amended:

(a) by omitting clause 23 (2) and by inserting instead the following subclauses:

(2) It is also lawful to use a try net in the waters specified in the Table to this clause to facilitate the taking of prawns by the means of a prawn net (hauling) if the try net complies with the following description:

The net is attached to a frame not exceeding 0.6 metre in width and 0.5 metre in height, with a total length from the centre of the plane to the extremity of the net not exceeding 2 metres; mesh not less than 30mm or more than 36mm.

(3) For the purposes of this Regulation or any other instrument

under the Act, a net described:

(a)

in subclause (1) or in the Table to this clause may be referred to as a prawn net (hauling); and

(b) in subclause (2) may be referred to as a try net (prawns).

by omitting clause 26 (2) and by inserting instead the following subclauses:

Table to this clause to facilitate the taking of prawns by the means of a seine net (prawns) if the try net complies with the following description:

The net is attached to a frame not exceeding 0.6 metre in width and O S metre in height, with a total length from the centre of the frame to the extremity of the net not

exceeding 2 metres; mesh not less than 30mm or more

than 36mm.

(3) For the purposes of this Regulation or any other instrument

under the Act, a net described:

(a)

in subclause (1) or in the Table to this clause may be referred to as a seine net (prawns); and

(b) in subclause (2) may be referred to as a try net (prawns).

EXPLANATORY NOTE

The object of this Regulation is to permit the use of try nets to facilitate the taking of prawns by means of prawn nets (hauling) or seine nets (prawns). A try net is a test net used in the prawning industry enabling fishermen to locate prawns without having to constantly shoot and haul either the prawn hauling net or the seine net.
