FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to garfish nets (bullringing) and the setting of meshing nets)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Fisheries and Oyster Farms Act 1935, has been

pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (Nets and Other Fishing Gear)

Regulation 1989 is amended:

(a)

by omitting from item 1 (b) of the Table to clause 19 the matter “36 mm” and by inserting instead the matter “45 mm”;

(b)

by omitting clause 30 (1) (b) and by inserting instead the following paragraphs:

(b) The net is not set (that is, used by any method other than splashing) during January and December in any year, or

between sunrise to sunset on any day during February,

March, October and November in any year.

(c) The net is not set for more than 3 hours.

EXPLANATORY NOTE

The objects of this Regulation are:

(a)

to increase the permissible maximum mesh size of garflsh nets (bullringing) which my be used to take garfish in the Clarence River; and

(b)

to make it clear that meshing nets may not be set (that is, used by any method other than splashing) during the months of January and December or between sunrise to sunset during the months of February, March, October and November in any year (king the periods in which they may be used by the method of splashing); and

(c) to provide that meshing nets must not be set for more than 3 hours.
