FISHERIES AND OYSTER FARMS ACT 1935—REGULATION
(Relating to daily log returns for fish trawling)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (General) Regulation 1989 is
amended:
(a) by inserting at the end of clause 55 the following subclause:
(2) In addition to any return that is required to be furnished in a form referred to in subclause (1), the form prescribed in relation to a return to be furnished by a person engaged in the taking of fish for sale by the method of trawling is, for the purposes of section 42, Form 26A.
(b) by inserting in Schedule 1 after Form 26 the following form:

EXPLANATORY NOTE
Section 42 of the Fisheries and Oyster Farms Act 1935 provides (in part) that the Minister may, by notice published in the Gazette, require persons engaged in the taking of fish for sale to keep records as prescribed and to furnish returns in the prescribed form as to (in part) the catch and the gear used in connection with the operatiions.
The object of this Regulation is to amend the Fisheries and Oyster Farms (General) Regulation 1989 to prescribe a form in relation to a return to be furnished by a person engaged in the taking of fish for sale by the method of trawling. The form will facilitate the daily recording of returns of catch by the method of trawling and the details collected from the returns will assist with the monitoring of catch by that method in New South Wales and Commonwealth waters.
