FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to crayfish, rock lobsters and crabs carrying ova)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fisheries and Oyster Farms Act 1935, has been pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (General) Regulation 1989 is amended

by omitting clause 45 and by inserting instead the following clause:

Crayfish, rock lob sters and crabs carrying ova

45. (1) A person must not take, sell, consign, forward, expose for sale or have in his or her possession a crayfish, or a rock lobster or a crab, carrying ova externally.

(2) A person must not have in his or her possession a crayfish, or a rock lobster or a crab, from which spawn or ova have been deliberately removed.

Maximum penalty: 50 penalty units

EXPLANATORY NOTE

Clause 45 of the Fisheries and Oyster Farms (General) Regulation 1989 prohibits the taking, possession, sale and consignment of a crayfish which is carrying ova externally. The clause also prohibits the possession of any crayfish from which

spawn or ova have been deliberately removed. The object of this regulation is to

extend that protection to rock lobsters and crabs.
