FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to bag limits, prohibited size fish and miscellaneous matters)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Fisheries and Oyster Farms Act 1935, has been

pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 11th June, 1993.

Amendments

2. The Fisheries and Oyster Farms (General) Regulation 1989 is

amended:

(a) by omitting clause 26 and by inserting instead the following

clause:

Permission to leave rod and line unattended

26. For the purposes of section 53 (3) of the Act, a person who is taking or attempting to take salmon or trout from any inland waters using a rod and line may leave that rod and line unattended
so long as the person remains within 10 metres of the rod and line

while it is unattended and the rod and line are within that person’s
line of sight.

(1A) A person must not:

(c)

have in possession in or on or adjacent to those waters more than the possession limit of those fish (as specified opposite that class of fish in Column 4 of Part 3 or 4 of that Table).

Maximum penalty: 50 penalty units.

(e) by omitting from clause 34 (2) the words “Subclause (1) (c) does not apply to or in respect of a person who has in possession more than the permitted quantity” and by inserting instead the words “Subclauses (1) (c) and (1A) (c) do not apply to or in respect of a person who has in possession more than the permitted quantity or possession limit”;
(f) by omitting Part 1 of the Table to clause 34 and by inserting instead the following matter.

Leaving of rod and line unattended

57. A person who is taking or attempting to take fish from any inland waters using a rod and line must not leave that rod and line unattended unless that person remains within 10 metres of the rod and line while it is unattended and the rod and line are within that person’s line of sight.

Maximum penalty: 50 penalty units

Prohibited lures and baits

58. (1) A person must not take or attempt to take any fish from

inland waters with a lure or bait that is:

(a) a live fin fish; or

(b)

any fish or any part of a fish of the Family Cyprindae (carp or goldfish) or any other species of fish not native to the waters of New South Wales; or

(c)

trout or salmon roe or any product containing trout or salmon roe.

(2) A person fishing in inland waters must, on the demand of an

inspector, produce to that inspector the lure or bait being used by

that person.

Maximum penalty: 50 penalty units

(i)    by inserting in clause 62A (1) (c), after the words “permitted quantity”, the matter “or daily limit”.

EXPLANATORY NOTE

The object of this Regulation is to amend the Fisheries and Oyster Farms (General) Regulation 1989 so as:

(a)

to allow a person fishing for trout or salmon to leave his or her rod and line unattended if the person remains within 10 metres of the rod and line and the rod and line are within that person’s line of sight; and

(b)

to prohibit a person taking or attempting to take fish from inland waters using a rod and line from leaving that rod and line unattended, unless that person remains within 10 metres of the rod and line and the rod and line are within that person’s line of sight; and

(c) to change the minimum prescribed measurement for a number of fish; and

(d) to introduce a daily possession limit in respect of some fish (in addition to the daily bag limit) and to vary the limits according to which waters the fish are taken from; and
(e) to allow the scales to be removed (in addition to the gills, as at present) from any species of fish which is the subject of a minimum size requirement before the fish are delivered or consigned for sale (tampering with fish restricts the enforcement of minimum size requirements and bag limits); and
(f) to prohibit the use of the following fish as baits and lures when fishing in

inland waters:

• live fin fish

• carp or goldfish or any other species of fish not native to the

waters of New South Wales

• trout or salmon roe (including any product containing trout or

salmon roe).

This Regulation is made under the Fisheries and Oyster Farms Act 1935, including section 53 (3), section 120 (2) (f), (g), (w), (qq), (rr) and (eee) and section 120 (3).
