FISHERIES AND OYSTER FARMS ACT 1935—REGULATION

(Relating to applications for boat licences)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Fisheries and Oyster Farms Act 1935, has been

pleased to make the Regulation set forth hereunder.

The Fisheries and Oyster Farms (General) Regulation 1989 is amended

by omitting Form 1 and by inserting instead the following form:

EXPLANATORY NOTE

The object of this Regulation is to shorten the form used by an applicant for the issue or renewal of a boat licence under the Fisheries and Oyster Farms Act 1935. Accordingly, a new Form 1 is to be inserted in the Fisheries and Oyster Farms (General) Regulation 1989.

The new form eliminates a number of entries which are no longer required, but now will require details of Commonwealth and interstate licences relating to the same boat and more information about the boat’s engines and fishing gear. The information about other licences is necessary in order to facilitate information sharing and parallel action by fisheries administrations in relation to licence “packages” for boats licensed in more than one place, and to ensure that the splitting of licence packages does not lead to an increase in the number of boats operating in Australian waters.

This Regulation is made under section 120 (2) (b) (forms) and section 120 (1)
(the general regulation-making power) of the Fisheries and Oyster Farms Act 1935.
