Fisheries (Amendment) Regulations 2002

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the

Fisheries Regulations 1998—

(a)	to make provision relating to the catching and possessing of certain species of fish that have been listed as threatened under the Flora and Fauna Guarantee Act 1988; and
(b)	to make minor amendments to those Regulations.

2. Authorising provision

These Regulations are made under section 153 of the Fisheries Act 1995.

3. Conditions of a Giant Crab Fishery Access Licence

In regulation 307A(2)(u) of the Fisheries
Regulations 19981, for "duplicate" substitute
"original".

4. Conditions of a Rock Lobster Fishery Access Licence In regulation 318(2) of the Fisheries Regulations 1998—

(a)	in paragraph (t), for "duplicate" substitute "original";
(b)	in paragraph (zc)(i), for "paragraph (zc)" substitute "paragraph (zd)";
(c)	in paragraph (zf)(i), for "paragraph (zb)" substitute "paragraph (zc)".

5. Minimum sizes

(1) In the Table in regulation 501(1) of the Fisheries

Regulations 1998—

(a) omit the item relating to "Macquarie perch"; and

(b) omit the item relating to "Murray cod".

(2) In the Table in regulation 501(2) of the Fisheries

Regulations 1998, after the item relating to

"Blackfish (River blackfish)" insert—

"Freshwater Inland waters within

Regulations 1998—

(a) omit the item relating to "Macquarie perch"; and

(b) omit the item relating to "Murray cod".

(2) In the Table in regulation 503(3) of the Fisheries

Regulations 1998, after the item relating to

"Blackfish (River blackfish)" insert—

7. Closed seasons

In the Table in regulation 506(1) of the Fisheries
Regulations 1998, for the item relating to

"Macquarie perch" substitute—

"Macquarie	All Victorian	1 October to
perch	waters	31 December in each year".

8.  Offence to land certain fish other than in the form of a carcass

(1) In regulation 520(2) of the Fisheries Regulations

1998 omit "Murray cod, Macquarie perch or".

(2) In regulation 520(3) of the Fisheries Regulations

1998, after "possess any" insert "freshwater
catfish, golden perch, Macquarie perch, Murray

cod, silver perch or".
