s1 3 s5 Fisheries Amendment (No. 6) No. 249, 1999 ˙ Short title 1. This regulation may be cited as the Fisheries Amendment Regulation (No. 6) 1999 . ˙ Regulation amended 2. This regulation amends the Fisheries Regulation 1995 . ˙ Replacement of pt 5, div 1 hdg 3. Part 5, division 1, heading— omit, insert— ‘ Division 1—Regulated fish, other than prawns ‘ Subdivision 1—Regulated fish declarations ’. ˙ Amendment of pt 5, divs 2 and 3 hdgs 4. Part 5, divisions 2 and 3, headings, ‘ Division ’— omit, insert— ‘ Subdivision ’. ˙ Insertion of new pt 5, div 2 5. Part 5, after section 25— insert— ‘ Division 2—Prawns regulated for recreational fishers ˙ ‘ Prawns regulated by volume ‘ 25A.(1) This section applies only— (a) to a recreational fisher; and (b) to prawns taken by the recreational fisher or another recreational fisher.

s6 4 s6 Fisheries Amendment (No. 6) No. 249, 1999 ‘ (2) More than a total of 10 L of prawns is regulated. ‘ (3) Taking or possessing more than a total of 10 L of prawns is prohibited. ˙ ‘ Measurement of volume of prawns ‘ 25B.(1) This section provides for how a total volume of prawns is measured. ‘ (2) The volume of any of the prawns that are in a container ( “contained prawns” ) must be measured by reference to the volume of the container when it is empty. ‘ (3) For subsection (2), a prawn is not a contained prawn if any part of it protrudes above the top of the container. ‘ (4) The volume of any of the prawns that are not contained prawns ( “uncontained prawns” ) must be measured by— (a) placing them in a container or containers so that no part of any of the prawns protrudes above the top of the container or containers; and (b) measuring the volume of each container when it is empty; and (c) reference to the volume of the container or containers. ‘ (5) The total volume is worked out by adding together the volume of all of the contained and uncontained prawns. ‘ (6) In this section— “prawn” includes part of a prawn. 1 ’. ˙ Insertion of new pt 11, div 1 hdg 6. After section 97— insert— ‘ Division 2—Prohibitions to allow identification or measurement of fish ’. ˙ Amendment of s 98 (Identifying and counting fish—general) 8. Section 98, heading— omit, insert— ‘ General prohibitions ’. ˙ Insertion of new s 98A 9. Part 11, after section 98— insert— ˙ ‘ Prohibition for prawns taken by recreational fishers ‘ 98A.(1) This section applies only to a recreational fisher for prawns taken by the recreational fisher or another recreational fisher. ‘ (2) The recreational fisher must not possess the prawns if more than 10 of the prawns have had their heads or any other part removed, unless the removal was to process the prawns for immediate consumption. Maximum penalty for subsection (2)—100 penalty units.’. ˙ Amendment of sch 8 (Recreational fishing—use of fishing apparatus) 10. Schedule 8, section 12(2), ‘be more than 6 m in diameter’— omit, insert— ‘have a length of more than 3.7 m’.

Schedule 16— insert— ‘prawn family Penaeidae’. ˙ Amendment of sch 17 (Dictionary) 12.(1) Schedule 17, part 1, definition “recreational fisher” — omit, insert— ‘ “recreational fisher” means a person, including a fisher, who takes or possesses fish, other than— (a) for trade or commerce; or (b) in the exercise or enjoyment of native title rights and interests in relation to land or waters under the Native Title Act 1993 (Cwlth).’. (2) Schedule 17, part 2, section 5— insert— ‘ (2A) “Length” , of a cast net, means the greater of the distances between the point where the net’s cord or rope is attached to the rest of the net and the following— (a) the net’s lead line; (b) the bottom of the net’s lowest pocket.’. (3) Schedule 17, part 2, section 5(3), after ‘trawl net’— insert— ‘or a cast net’. (4) Schedule 17, section 5(2A) to (4)— renumber as schedule 17, part 2, section 5(3) to (5).
