s1 2 s5 Fisheries Amendment (No. 5) No. 361, 2000 ˙ Short title 1. This regulation may be cited as the Fisheries Amendment Regulation (No. 5) 2000 . ˙ Regulation amended 2. This regulation amends the Fisheries Regulation 1995 . ˙ Insertion of new s 2A 3. Part 2, division 2— insert — ˙ ‘ References to latitudes and longitudes ‘ 2A.(1) Latitudes and longitudes mentioned in this regulation or a management plan are worked out using the Australian Geodetic Datum 1966 , commonly called ‘AGD66’, notified in the Commonwealth Government Gazette No. 84 on 6 October 1966, at page 4984. ‘ (2) However, subsection (1) does not apply for a management plan if it provides for another system for working out latitudes and longitudes.’. ˙ Amendment of s 13 (Publication of draft management plans) 4. Section 13(1) and (2)— omit, insert — ‘ 13.(1) The chief executive must notify the preparation of a draft management plan in the gazette and a newspaper circulating generally throughout the State.’. ˙ Amendment of s 62 (Particulars to be contained in register of authorities) 5. Section 62— insert — ‘(i) for a ‘T1’ or ‘T2’ licence under the East Coast Trawl Plan—the particulars recorded in the effort unit certificate for the licence

s6 3 s7 Fisheries Amendment (No. 5) No. 361, 2000 under the plan; (j) for an ‘M2’ licence under the East Coast Trawl Plan—its mark under section 103 and the following details under the plan about the boat identified in the licence— (i) its hull units; (ii) its beam, depth and length; (iii) its main engine power in maximum continuous brake kW.’. ˙ Amendment of s 99A (Prescribed entities for delegation or subdelegation—Act, s 28) 6.(1) Section 99A(2) and (3), after ‘delegate’— insert — ‘under subsection (1)’. (2) Section 99A— insert — ‘ (3A) For section 21(1)(a) of the Act, the chief executive may also delegate the chief executive’s power to make a decision under the East Coast Trawl Plan, chapter 3, part 5A, about effort units to the independent review committee, as constituted from time to time, established by the chief executive for matters relating to the administration of the plan.’. (3) Section 99A(3A) and (4)— renumber as section 99A(4) and (5). ˙ Insertion of new s 110A 7. Part 12, division 1— insert — ˙ ‘ Prescribed matter for certificates—Act, s 184(4)(g) ‘ 110A. For section 184(4)(g) 1 of the Act, the following are prescribed— 1 Section 184 (Evidentiary provisions) of the Act

s8 4 s9 Fisheries Amendment (No. 5) No. 361, 2000 (a) information, or a summary of information, from returns— (i) given to the chief executive under section 109; or (ii) held by the chief executive that were given to— (A) the former Queensland Fisheries Management Authority under section 109; or (B) the former Queensland Fish Management Authority under the repealed Fishing Industry Organisation and Marketing Act 1982 ; 2 (b) the hull units for a boat, worked out under the East Coast Trawl Plan.’. ˙ Insertion of new s 114 8. After section 113— insert — ˙ ‘ Renumbering of references to East Coast Trawl Plan ‘ 114.(1) This section applies on the production of the next reprint of the East Coast Trawl Plan, mentioned in section 175A of the plan (the “plan reprint” ). ‘ (2) In the next reprint of this regulation (the “regulation reprint” ), a reference to a provision of the plan, must, if the context permits, be changed to agree with the numbering and renumbering of the plan under the plan reprint. ‘ (3) This section expires 3 months after the regulation reprint is produced.’. ˙ Amendment of sch 10 (Fees) 9.(1) Schedule 10, items 5(b)(ii) and 5(d)(i), ‘ ‘T1’ or ‘T2’ ’— omit, insert — 2 See the repealed Fishing Industry Organisation and Marketing Regulations 1991 , section 21 (Monthly returns).

(2) Schedule 10, item 5(d)— insert — ‘(iv) for a transfer of effort units under the East Coast Trawl Plan . . . . . . . . . . . . . 375.00’. ˙ Amendments for ‘East Coast Trawl Plan’ references 10.(1) This section amends the following provisions— • section 49(a) • section 73(1)(b) • section 110(2) • schedule 10, items 5(b)(ii) and 5(d)(i) • schedule 17, section 12(1). (2) In the provisions mentioned in subsection (1), Fisheries ‘ (East Coast Trawl) Management Plan 1999 ’— omit, insert — ‘East Coast Trawl Plan’.
