s1 2 s3 Fisheries Amendment (No. 5) No. 118, 1997 ˙ Short title 1. This regulation may be cited as the Fisheries Amendment Regulation (No. 5) 1997 . ˙ Regulation amended 2. This regulation amends the Fisheries Regulation 1995 . ˙ Amendment of sch 2 (Closed waters—commercial fishing) 3.(1) Schedule 2, section 5— omit, insert — ‘ Macintyre Brook at Coolmunda Dam, Whetstone and Bendor Weirs ‘ 5. Macintyre Brook— (a) upstream waters within 200 m of the Coolmunda Dam spillway wall; and (b) downstream waters within 100 m of the Coolmunda Dam wall; and (c) from 400 m upstream to 400 m downstream of Whetstone Weir or Bendor Weir.’. (2) Schedule 2, section 12, ‘400 m upstream’— omit, insert— ‘90 m upstream’. (3) Schedule 2, after section 29— insert — ‘ Fitzroy River at Eden Bann Weir ‘ 29A. The Fitzroy River from 200 m upstream to 400 m downstream of Eden Bann Weir. ‘ Fitzroy River at Wattlebank Control Weir ‘ 29B. The Fitzroy River from 200 m upstream to 200 m downstream of Wattlebank Control Weir.’.

(5) Schedule 3, after section 76— insert— ‘ Main wharf at Port Denison, Bowen ‘ 76A. Waters under or within 100 m of— (a) the main wharf at Port Denison, Bowen; and (b) a structure attached to the wharf.’. ˙ Amendment of sch 11 (Crab fisheries (commercial)) 5.(1) Schedule 11, sections 16A, 35A and 45A— omit. (2) Schedule 11, section 18(2), after ‘daily quota’— insert — ‘of spanner crabs that may be taken or possessed in managed area A’. (3) Schedule 11, section 18B, words after ‘fish’— omit, insert — ‘for spanner crabs— (a) in managed area A; and (b) on a quota day under section 18(2).’. (4) Schedule 11, after section 18B— insert — ‘ Bringing ashore only at Bundaberg for 400 kg daily quota ‘ 18C. If an authority holder’s daily quota is 400 kg under section 18(2), the holder may only bring spanner crabs taken in managed area A ashore at Bundaberg.’. (5) Schedule 11, section 37(2), after ‘daily quota’— insert —

(6) Schedule 11, section 37B, words after ‘fish’— omit, insert — ‘for spanner crabs— (a) in the part of the fishery that is in managed area A; and (b) on a quota day under section 37(2).’. (7) Schedule 11, after section 37B— insert — ‘ Bringing ashore only at Bundaberg for 400 kg daily quota ‘ 37C. If an authority holder’s daily quota is 400 kg under section 37(2), the holder may only bring spanner crabs taken in managed area A ashore at Bundaberg.’. (8) Schedule 11, after section 47B— insert — ‘ Bringing ashore only at Bundaberg for 400 kg daily quota ‘ 47C.
