s1 2 s3 Fisheries Amendment (No. 4) No. 265, 2000 ˙ Short title 1. This regulation may be cited as the Fisheries Amendment Regulation (No. 4) 2000 . ˙ Regulation amended 2. This regulation amends the Fisheries Regulation 1995 . ˙ Replacement of s 99A (Prescribed entities for delegation or subdelegation—Act, s 28) 3. Section 99A— omit, insert— ˙ ‘ Prescribed entity—chief executive’s power under s 20A(1)(h) of the Act for delegation or subdelegation ‘ 99A.(1) For section 21(1)(a) of the Act, the chief executive may delegate— (a) the chief executive’s power, under section 20A(1)(h) 1 of the Act, to formulate and operate arrangements, including funding, for adjusting the use of fisheries resources to the Queensland Rural Adjustment Authority; and (b) the chief executive’s power, under the Fisheries (Freshwater) Management Plan 1999 , section 44, 2 to issue a permit to fish in a stocked impoundment to— (i) a government entity under the Public Service Act 1996 ; 3 or (ii) a fish stocking group that is a body corporate; or (iii) a person who owns or manages a— 1 Section 20A (Powers) of the Act 2 Fisheries (Freshwater) Management Plan 1999 , section 44 (Permit to fish with fishing line or set line in stocked impoundment) 3 See the Public Service Act 1996 , section 21 (What is a “government entity”) for definition.

s3 3 s3 Fisheries Amendment (No. 4) No. 265, 2000 (A) bait or tackle shop, kiosk, service station or other retail business; or (B) tourist information centre. ‘ (2) However, the delegate must be an appropriately qualified person. ‘ (3) The delegate may subdelegate the power to an employee, member or officer of the delegate only if the subdelegate is an appropriately qualified person. ‘ (4) In this section— “appropriately qualified” includes having the qualifications, experience or standing appropriate to exercise the power. “Queensland Rural Adjustment Authority” means the Queensland Rural Adjustment Authority established under the RuralAdjustmentAuthority Act 1994 .’.
