s1 3 s5 Fisheries Amendment Regulation (No. 3) 2002 No. 337, 2002 1 Short title This regulation may be cited as the Fisheries Amendment Regulation (No. 3) 2002 . 2 Regulation amended This regulation amends the Fisheries Regulation 1995. 3 Amendment of s 10 (Scientific names of fish) Section 10(2)— insert— ‘(g) for noxious fisheries resources, other than electric eel, tigerfish (African) or tigerfish (South American) or trahira—Eschmeyer, W.N. 1998, Catalog of fishes, California Academy of Sciences, San Francisco; 1 and (h) for electric eel—Nelson, J.S. 1984, Fishes of the world, John Wiley & Sons, New York; and (i) for tigerfish (African) or tigerfish (South American) or trahira—Gery, J. 1977, Characoids of the world, TFH Publications, Neptune City, New York and Nelson, J.S. 1984, Fishes of the world, John Wiley & Sons, New York.’. 4 Amendment of s 14 (Closed season for barramundi) Section 14(2) and (3)— omit. 5 Insertion of new ss 14A and 14B After section 14— insert— 1 The catalog is also available at s6 4 s7 Fisheries Amendment Regulation (No. 3) 2002 No. 337, 2002 ‘14A Closed season for Australian bass ‘The period from 1 June to 31 August is a closed season for Australian bass for all tidal waters. 2 ‘14B Prohibited activities ‘The following activities are prohibited— (a) taking fish to which a closed season under this division applies during the closed season; (b) possessing fish taken in contravention of paragraph (a).’. ‘14C General exemption ‘It is not unlawful for a person during a closed season under this division to unintentionally take fish to which the closed season applies if— (a) the fish is not unintentionally or recklessly injured or damaged; and (b) is immediately put back.’. 6 Amendment of s 15 (Barramundi closed season exemption for recreational fishers) Section 15, heading— omit, insert— ‘15 Exemption for barramundi ’. 7 Insertion of new pt 5B After part 5A— insert 2 Note there is also a closed season declaration for Australian bass under the Fisheries (Freshwater) Management Plan 1999 , section 6.
