s1 2 s4 Fisheries Amendment (No. 3) No. 422, 1996 ˙ Short title 1. This regulation may be cited as the Fisheries Amendment Regulation (No. 3) 1996 . ˙ Regulation amended 2. This regulation amends the Fisheries Regulation 1995 . ˙ Insertion of new s 24A 3. After section 24— insert— ˙ ‘ Exemptions for Mary River cod ‘ 24A. Despite section 18, 1 a person may take or possess 1 Mary River cod taken from the following dams or waterway barrier works upstream from the dams— • Bill Gunn Dam • Cressbrook Dam • Hinze Dam • Maroon Dam • Moogerah Dam • North Pine Dam • Somerset Dam • Wivenhoe Dam.’. ˙ Amendment of s 25 (Other exemptions) 4. Section 25(2)— omit, insert— 1 Section 18 (Regulated fish)

s5 3 s6 Fisheries Amendment (No. 3) No. 422, 1996 ‘ (2) Despite section 18, 2 a person may— (a) possess a regulated fish if the fish is an aquarium display fish bred by the person for aquarium display; or (b) possess or sell a regulated fish if an inspector is reasonably satisfied the person has obtained the fish from— (i) the holder of an authority allowing the holder to sell the fish; or (ii) another person who has obtained the fish from a holder mentioned in subparagraph (i).’. ˙ Amendment of s 35 (Permits Authority may issue) 5. Section 35(2)— insert— ‘• conducting commercial fishing competitions’. ˙ Insertion of new s 70A 6. After section 70— insert— ˙ ‘ Conducting commercial fishing competitions ‘ 70A. A person may conduct a commercial fishing competition only if— (a) the person holds a general fisheries permit for the commercial fishing competition; and (b) each person fishing in the competition has paid the fee payable under schedule 10, part 2. 3 ’. 2 Section 18 (Regulated fish) 3 Schedule 10, part 2 (Fees payable to the Authority)

Section 79(2)— omit, insert— ‘ (2) Subsection (1) does not apply to a person who removes, damages or destroys a marine plant that the chief executive is reasonably satisfied is or may be a danger to public health or safety.’. ˙ Insertion of new s 91A 8. After section 91— insert— ˙ ‘ Possession or sale of crab claws by fishers 91A.(1) A fisher who takes a crab under an authority must not possess or sell the crab’s claws unless— (a) the fisher possesses or sells— (i) if the crab was taken with 1 claw—the claw; or (ii) if the crab was taken with 2 claws—both claws; and (b) the fisher possesses or sells the crab’s body. Maximum penalty—100 penalty units. ‘ (2) In this section— “crab body” means a crab body that has its carapace attached to it.’. ˙ Amendment of sch 4 (Regulated fish) 9.(1) Schedule 4, part 3, division 3, from ‘Mary River cod’ to ‘1’ (first mention)— omit. (2) Schedule 4, part 3, division 4, after ‘ Reef fish ’— insert— ‘barramundi cod—less than 40 cm’.
