s1 2 s3 Fisheries Amendment (No. 3) No. 270, 1995 ˙ Short title 1. This regulation may be cited as the Fisheries Amendment Regulation (No. 3) 1995 . ˙ Regulation amended 2. This regulation amends the Fisheries Regulation 1995 . ˙ Insertion of new s 26B 3. After section 26A— insert— ˙ ‘ Closed waters—Shoalwater Bay ‘ 26B.(1) Waters of Shoalwater Bay within the following boundary are closed— • from the shore at Macdonald Point in a straight line to Cape Townshend, Townshend Island • along the island’s western and southern shores to the island’s eastern tip • in a straight line to Reef Point • along the shore to Macdonald Point. ‘ (2) For subsection (1)— (a) the boundary crosses each waterway joining it by the shortest straight line across the mouth of the waterway; and (b) boundaries along a shore follow high water mark. ‘ (3) The use or possession of a drift net or set gill net in the closed waters is prohibited. ‘ (4) However, subsection (3) does not apply to the use or possession of a drift net by a commercial fisher if the fisher is within 100 metres of the net. ‘ (5) In this section— “drift net” means a drift net under the Fishing Industry Organisation and Marketing Regulation 1991 , schedule 5, serial number 17.

s3 3 s3 Fisheries Amendment (No. 3) No. 270, 1995 “set gill net” means an east coast foreshore set gill net or offshore set gill net under the Fishing Industry Organisation and Marketing Regulation 1991 , schedule 5, serial numbers 15 and 17’.
