s1 2 s3 Fisheries Amendment Regulation (No. 2) 2001 No. 151, 2001 1 Short title This regulation may be cited as the Fisheries Amendment Regulation (No. 2) 2001 . 2 Regulation amended This regulation amends the Fisheries Regulation 1995. 3 Insertion of new s 16A After section 16— insert ‘16A Closed waters—reef world heritage area (1) This section applies if, in the reef world heritage area during an effort year as follows, all of the fishing and steaming days are used for the following total number of notional effort units for the year— (a) for 2001—2 264 471; (b) for 2002—2 193 731; (c) for 2003—2 125 113. (2) The waters of the reef world heritage area are closed from midday on the day that is 5 clear days after the day on which the fishing and steaming days are used until midday on 1 January in the next year. Example for subsection (2) If the fishing and steaming days are used on a Monday, the waters are closed from midday on the next Sunday until midday on 1 January in the next year. (3) Immediately after the fishing and steaming days are used, the chief executive must give notice to the persons mentioned in subsection (4) of— (a) the date the fishing and steaming days were used; and (b) the date the waters become closed waters under subsection (2). (4) For subsection (3), the persons are— (a) each holder of a licence with a ‘T1’ fishery symbol on it; and (b) each person in control of a boat identified in a licence with a ‘T1’ fishery symbol on it.
s3 3 s3 Fisheries Amendment Regulation (No. 2) 2001 No. 151, 2001 (5) The notice must be given— (a) for subsection (4)(a)—in writing; or (b) for subsection (4)(b)—by a communication mode nominated by the licence holder under the East Coast Trawl Plan, section 57B(1). 1 (6) The following activities done under a licence with a ‘T1’ fishery symbol written on it are prohibited in the closed waters— (a) using or possessing a trawl net under the fishery symbol; (b) possessing fish taken by the use of a trawl net under the fishery symbol. (7) Section 16(4) and (5) applies in relation to the closed waters. (8) In this section— “effort year” see the East Coast Trawl Plan, schedule 7, part 4. “fishing days” see the East Coast Trawl Plan, schedule 7, part 4. “notional effort units” , for an effort year, see the East Coast Trawl Plan, section 227A(5). “reef world heritage area” means the area within the following boundary— from the northern tip of Cape York Peninsula at low water mark to latitude 10º40.91' south, longitude 145º00.06' east to latitude 12º59.91' south, longitude 145º00.06' east to latitude 14º59.91' south, longitude 146º00.06' east to latitude 17º29.91' south, longitude 147º00.06' east to latitude 20º59.91' south, longitude 152º55.06' east to latitude 24º29.90' south, longitude 154º00.06' east to the mainland shore at its intersection with latitude 24º29.91' south at low water mark along the shore at low water mark to the northern tip of Cape York Peninsula at low water mark. 1 East Coast Trawl Plan, section 57B (Obligation to nominate communication mode for boat)
