s1 3 s5 Fisheries Amendment (No. 10) No. 476, 1997 ˙ Short title 1. This regulation may be cited as the Fisheries Amendment Regulation (No. 10) 1997 . ˙ Regulation amended 2. This regulation amends the Fisheries Regulation 1995 . ˙ Amendment of s 42 (Restrictions on writing fishery symbols on authorities allowing the use of boats in commercial fisheries) 3. Section 42— insert— ‘ (5) The Authority must not write the fishery symbol ‘N3’ and the fishery symbol ‘N9’ on the same primary commercial fishing boat licence.’. ˙ Amendment of s 66 (Prohibited ways of taking fish) 4.(1) Section 66(e)— renumber as section 66(f). (2) Section 66— insert— ‘(e) using a power assisted device to set or use a net mentioned in schedule 13, part 5 or 5A;’. ˙ Amendment of sch 1 (Closed seasons) 5. Schedule 1, section 3, ‘midnight’— omit, insert— ‘midday’.

Schedule 13— insert— ‘ PART 5A—NET FISHERY (GULF OF CARPENTARIA No. 2) ‘ Division 1—Preliminary ˙ ‘ Fishery symbol ‘ 68A. The fishery symbol is ‘N9’. ˙ ‘ Fishery area ‘ 68B. The fishery area comprises the tidal waters in the Gulf of Carpentaria between the 25 n mile line and the 6 n mile line and south of latitude 10°48'. ˙ ‘ What fish may be taken ‘ 68C. Only the following fish may be taken— (a) black or spotted jewfish; (b) blue salmon; (c) grey mackerel; (d) jewel fish; (e) king salmon; (f) queenfish; (g) spotted grunter bream (grunter); (h) other fish (other than barramundi) taken while taking fish mentioned in paragraphs (a) to (g).
s 10 6 s 10 Fisheries Amendment (No. 10) No. 476, 1997 ˙ ‘ Permitted ways of taking fish ‘ 68D.(1) Fish may only be taken by using a mesh net. ‘ (2) A power assisted device may only be used with a net if— (a) no more than 1200 m of the net is attached to the device; and (b) all other nets on board a boat from which the net is used are stowed and secured. ˙ ‘ Time quota ‘ 68E. A net may only be used other than during the closed season for barramundi. 1 ‘ Division 2—Use of nets ˙ ‘ Use of nets in the fishery area ‘ 68F.(1) A net may only be used in the fishery area if the net is not longer than 600 m and has a mesh size of at least 162.5 mm but no more than 245 mm. ‘ (2) The line thickness of a net must not be less than 0.9 mm. ‘ (3) A ring net must not be used. ‘ (4) Two nets may only be joined and used as a single net if— (a) they are used in waters deeper than 20 m; and (b) the combined length of the nets is no more than 1200 m. ‘ (5) A person using a net must be within 100 m of it. 1 For the closed season, see schedule 1, section 1 (Barramundi—Gulf of Carpentaria).
s 11 7 s 11 Fisheries Amendment (No. 10) No. 476, 1997 ‘ Division 3—Miscellaneous ˙ ‘ Use of primary commercial fishing boats ‘ 68G. A primary commercial fishing boat must not be longer than 14 m. ˙ ‘ Use of tender commercial fishing boats ‘ 68H. A tender commercial fishing boat must not be used more than 800 m from its primary commercial fishing boat. ˙ ‘ Permitted distance for an assistant fisher to be under direction ‘ 68I. The permitted distance for an assistant fisher to be under direction is 800 m.’. ˙ Amendment of sch 17 (Dictionary) 11. Schedule 17, part 1— insert — ‘ “power assisted device” means an electrical or mechanical device for setting or retrieving fishing apparatus. “the 6 n mile line” means a line parallel to the territorial sea baseline and 6 n miles out to sea.’.
