s1 2 s5 Fisheries Amendment Regulation (No. 1) 2005 No. 23, 2005 1 Short title This regulation may be cited as the Fisheries Amendment Regulation (No. 1) 2005 . 2 Regulation amended This regulation amends the Fisheries Regulation 1995. 3 Amendment of s 58I (Requirement to give transhipment notice) Section 58I(4), definition commercial ship , ‘ 1995 , schedule 11’— omit, insert— ‘ 2004 , schedule 15’. 4 Amendment of sch 5B (Special provisions for spanish mackerel commercial fishery) Schedule 5B, section 1, definition former Authority — relocate to schedule 17, part 2. 5 Amendment of sch 7 (Fish habitat areas) (1) Schedule 7, sections 1, 9 and 23— omit . (2) Schedule 7— insert— ‘40A Edgecumbe Bay ‘(1) The Edgecumbe Bay fish habitat area is shown on plan FHA–069. ‘(2) The area does not include any of the following— (a) the area shown and described on the plan as ‘Exclusion Area (approx 2.5HA)’; (b) the area shown and described on the plan as ‘Exclusion Area (approx 20HA)’.

s5 3 s5 Fisheries Amendment Regulation (No. 1) 2005 No. 23, 2005 ‘51A Margaret Bay (Wuthathi) ‘(1) The Margaret Bay (Wuthathi) fish habitat area is shown on plan FHA–070. ‘(2) The area does not include the area adjacent to the northern and western sides of Hicks Island shown and described on the plan as ‘Exclusion Area’. ‘66A Starcke River (Ngulun) ‘(1) The Starcke River (Ngulun) fish habitat area is shown on plan FHA–068. ‘(2) The area includes the tidal land of the part of lot 18 on SP 104580 that is within the outer boundary shown on the plan. ‘(3) However, the area does not include any of the following— (a) lot 7 on CP892329; (b) the 150m x 350m area at the mouth of the Starcke River shown and described on the plan as ‘Future Exclusion Area’.’. (3) Schedule 7, section 28(1), after ‘FHA–030’— insert— ‘(Revision 1)’. (4) Schedule 7, sections 2 to 66A— renumber as sections 1 to 66.
