s1 2 s4 Fisheries Amendment (No. 1) No. 94, 1995 ˙ Short title 1. This regulation may be cited as the Fisheries Amendment Regulation (No. 1) 1995 . ˙ Regulation amended 2. This regulation amends the Fisheries Regulation 1995 . ˙ Amendment of s 2 (Definitions) 3. Section 2— insert— ‘ “plan” , for a fish habitat area, means— (a) for land described by reference to a lot—a plan held by the department administering the Land Title Act 1994 ; or (b) if paragraph (a) does not apply—a plan held by the department. 1 “railway land” means land vested in Queensland Railways. “road” has the same meaning as in the Land Act 1994 . “unallocated state land” has the same meaning as in the Land Act 1994 .’. ˙ Insertion of new s 26A 4. After section 26— insert— ˙ ‘ Fish habitat areas ‘ 26A. Each area of land and waters described in schedule 2 is a fish habitat area.’. 1 Plans held by the department may be inspected at its office at 41 George Street Brisbane.

s5 3 Fisheries Amendment (No. 1) ˙ Insertion of new sch 2 5. After schedule 1— insert— ‘ SCHEDULE 2 s5 No. 94, 1995 ‘ FISH HABITAT AREAS section 26A of the regulation ˙ ‘ Bassett Basin ‘ 1. Tidal land (other than unallocated State land) and waters within the outer boundary shown on plan no. 033–030, 2 other than within— (a) a channel marked by aids to navigation under the TransportOperations (Marine Safety) Act 1994 ; or (b) a waterway, between lines drawn parallel to, and 20 m either side of, a road across the waterway; or (c) the area a bridge would occupy if it joined roads ending at the edge of a waterway on either side of the waterway; or (d) 20 m either side of the area mentioned in paragraph (c); or (e) 20 m of railway land; or (f) the following lots— • lots 593 and 594 on plan CI 3002 • lot 265 on plan CI 3220 • lots 607 and 608 on plan CI 4312 • lot 1 on RP 736461.’. 2 The area is at Mackay.
