Fisheries Adjustment Schemes Amendment

Regulations 2001

Made by the Governor in Ixectitive Council.

1.           Citation

These regulations may be cited as the Fisheries Adjustment
Schemes Amendment Regulations 2001.

2.           The regulations amended

The amendments in these regulations are to the Fisheries
Adjustment Schemes Regulations 1988*.

3.            Regulation 8 amended

" subregulation (1)(a) or (b)
(1) Regulation 8(1) is amended as follows:
(a) after paragraph (a) by deleting "or";

(b)

in paragraph (b) by deleting the comma and inserting instead —

(c)

a determination under section 8 of the Compensation Act; or

(d)

a determination under section 10 of the Compensation Act,

(2) Regulation 8(2) is amended by deleting "subregulation (1)" and

inserting instead —

(3) After regulation 8(2) the following subregulation is inserted - 44

(2a) An application referred to in subregulation (1)(c) or (d)

shall be sent to the Executive Director at the head

office of the Department in Perth accompanied by —

(a)

a copy of the application for compensation under section 7 of the Compensation Act made to the Minister;

(b)

a copy of any advice given by the Minister under section 8(1) of the Compensation Act;

(c)

a copy of the authorization held by the affected person, as defined in the Compensation Act, in respect of which the claim for compensation was made;

(d)

a copy of any order, amendment to a management plan or substituted management plan or notice which caused the entitlement to compensation under the Compensation Act to arise;

(e)

a copy of any certificate by the Executive Director issued under section 5 of the Compensation Act;

(1) any other information that the applicant

considers relevant to the determination of
whether or not the affected person, as defined
in the Compensation Act, is entitled to
compensation or to the amount of compensation

payable to the affected person; and

(g) if the applicant is the affected person, a fee of

$300.
