(l) Short title. This Act may be cited as "The Fisheries Acts Amendment Act of 1962." (2) Principal Act. "The Fisheries Acts, 1957 to 1959," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as "The Fisheries Acts, 1957 to 1962." 2. Amendment of section 3 (,·i). Section three of the Principal Act 1s amended by inserting in paragraph (vi) after the words "hoop net" the words "or such other net as the Governor in Council may at any time and from time to time by Order in Council declare (and the Governor in Council is hereby authorised so to declare)'".
74 Fisheries Acts Amendment Act of 1962, No. 10 3. Amendment of section 6 (1). Section six of the Principal Act is amended by omitting the definition "Inspector" in subsection (1) and inserting in its stead the following definition:- " "Inspector"-The Chief Inspector and any inspector or sub- inspector appointed under this Act, and any member of the Police Force: The term includes any person acting under the direction or in aid of an inspector within the meaning of the foregoing provisions of this definition : In the case of a person appointed under this Act by the Minister to act as an honorary inspector, subject to any limitations imposed by the Minister in respect of the appointment, the term includes such person and also any other pet'Son acting under his direction or in his aid;". 4. Amendment of section 8. Section eig.ltt of the Principal Act is amended by omitting subsection (2) and inserting in its stead the following subsection:- "(2) Every member of the Police Force shall be, ex officio, an inspector under and for the purposes of this Act." 5. Amendment of section 28. Section twenty-eight of the Principal Act is amended by- (a) adding to subsection (t) the following paragraphs:- ..Where a license is granted to any person under this section, the Governor in Council- (i) shall, on the granting of such license, determine the fee to be paid under this Act for the grant of such license, and the fees to be paid under this Act during the continuance of such license, and the manner of payment and the times and places when and where such fees shall be paid; (ii) may, at any time and from time to time during the currency of such license, re-determine the amount of the fees to be paid under this Act during the continuance of such license, and the manner of payment and the times and places when and where such fees shall be paid. Any such fees may be determined or re-determined on such basis or bases as the Governor in Council thinks fit. The Chief Inspector shall give notice to the licensee of the determination and every re-determination of fees made under this subsection."; (b) omitting paragraph (vi) of subsection (2) and inserting in its stead the following paragraph:- "(vi) shall remain in force during the period of time for which it is granted subject to the payment by the licensee of the fees determined by the Governor in Council under subsection (1) of this section (including any fees re-determined under that subsection) at the respective times and in the manner specified in such determination or re-determination, as the case may be, and subject otherwise to subsection (3) of this section;"; and
Fisheries Acts Amendment Act of 1962, No. 10 (c) omitting paragraph (vii) of subsection (3) and inserting in its stead the following paragraph:- "(vii) That the fees for the grant or the continuance of the license as determined or re-determined by the Governor in Council under subsection (1) of this section, or any of such fees, have not been paid in accordance with such determination or re-determination, as the case may be,". 6. Amendment of section 92 (4), Section ninety-two of the Principal .Act is amended by omitting from subsection (4) the proviso to that subsection. 75
