AN ACT to amend the Fisheries Act, 1905-1965.

[Assented to 31st October, 1966.]

RE it enacted by the Queen's Most Excellent n Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation.

1. (1) This Act may be cited as the Fisheries

Act Amendment Act, 1966.

(2) In this Act the Fisheries Act, 1905-1965, is 1966.

referred to as the principal Act.

(3) The principal Act as amended by this Act

may be cited as the Fisheries Act, 1905-1966.

Long Title

amended.	2. The long title to the principal Act is amended by adding after the word, "fish" in line two, the words, "and marine algal life".

amended.	3. Section three of the principal Act is amended by adding immediately after the interpretation, "Long line or bultow", the following interpreta- tion

"Marine algal life" includes sea-weeds and other marine plants of the class Algae, on or under the seabed in Western Australian waters below low water mark; .

amended. 4. Section six of the principal Act is amended

(a)	by inserting after the word, "fish" in line two of paragraph (c) of subsection (1), the words, "or of any marine algal life"; and
(b)	by adding after the word, "fisheries" in line two of paragraph (n) of subsection (1), the words, "or to marine algal life".

amended. 5. Section nine of the principal Act is amended

(a) by substituting for the passage, "whatso- ever," in line two of paragraph (d) of subsection (1), the following passage

whatsoever;

(e) taking any marine algal life what- soever, ; and

(b) by inserting after the word, "fish" in the last line of subsection (2), the words, "or marine algal life".

6. Section eleven of the principal Act is amended by inserting after the word, "fish" in line two of paragraph (c), the words, "or marine algal life".

Section twelve of the principal Act is amended by adding after the word, "crayfish" in line two of paragraph (b) of subsection (2), the passage, ", or if the offence relates to marine algal life".

(a)	by inserting after the word, "aircraft" in line seven of paragraph (b) of subsection (la), the words, "or in any receptacle for fish";
(b)	by substituting for the words, "all fish" in line seven of subsection (lb), the passage, "may also seize any receptacle in which the fish so seized are contained, and all fish and receptacles"; and
(c)	by substituting for the words, "all cray- fish" in lines seven and eight of subsection (3a) the passage, "may also seize any receptacle in which the crayfish so seized are contained, and all crayfish and receptacles".

11. Section twenty-four A of the principal Act 8.24A

amended.

is amended—

(a)	by inserting after the word, "aircraft" in line seven of paragraph (a) of subsection (la), the words, "or in any receptacle for fish"; and
(b)	by substituting for the words, "all crayfish tails" in line nine of subsection (2), the passage, "may also seize any receptacle in which the crayfish tails so seized are contained, and all crayfish tails and receptacles".

&mended. 12. Section twenty-four D of the principal Act is amended

(a)	by deleting the words, "or boat" in line six; and
(b)	by inserting after the word, "whatsoever" in line eight, the passage, ", or any boat that is licensed as a processing establish- ment pursuant to the provisions of Part IIIB of this Act".

amended.	13. Section thirty-five G of the principal Act is amended by substituting for the passage, "within thirty days after the license is granted or, as the case may be, renewed" in the last three lines of subsection (2), the passage, "in two moieties, the first of which shall be paid within thirty days after the license is granted, or as the case may be, renewed and the other within a period of six months thereafter".

amended.	14. Section thirty-nine of the principal Act is amended by inserting after the word, "animal" where that word occurs in

(a) line nine of subsection (1);

(b)	line six of subsection (2); and
(c)	line three of the first proviso to subsection (2),

the words, "or algal", in each case.

15. Section fifty of the principal Act is amended by inserting after the word, "fish" in the penul- timate line, the words, "and receptacles".
