An Act to amend the Fish River Water Supply Administration Act, 1945, in respect of the payment of interest, and in other respects. [Assented to, 16th December, 1982.]

Fish River Water Supply Administration (Amendment).

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1. This Act may be cited as the "Fish River Water Supply Administra-

tion (Amendment) Act, 1982".

Principal Act.

1. The Fish River Water Supply Administration Act, 1945, is referred

to in this Act as the Principal Act.

Schedules.

1. This Act contains the following Schedules:—

   SCHEDULE 1.—AMENDMENTS TO THE PRINCIPAL ACT.

   SCHEDULE 2.—AMENDMENTS TO THE PRINCIPAL ACT BY WAY OF

   STATUTE LAW REVISION.

Amendment of Act No. 16, 1945.

4.     The Principal Act is amended in the manner set forth in Schedules 1

and 2.

Transitional provision.

The sum required, pursuant to section 13 (2) of the Principal Act (as in force immediately before the commencement of this Act), to be credited as soon as practicable after 31st December, 1981, to the Fish River Water Supply Renewal Reserve Account kept under that Act shall be the sum required, pursuant to section 13 (2) of the Principal Act (as amended by this Act), to be credited to that account not later than 31st December, 1982.

(Sec. 4.)

AMENDMENTS TO THE PRINCIPAL ACT.

(1) (a) Section 13 (2 )—

Omit the subsection, insert instead:—

(2) There shall be credited to the Renewal Reserve Account not later than 31st December in each year such sum as the Treasurer may approve.

(b) Section 13 (5 )—

Omit "but not exceeding four per centum per annum".

(c) Section 13 (6 )—

Omit "such contribution or portion thereof may be allowed to remain a charge on the Working Account", insert instead "pay- ment of those contributions, or any part thereof, may be deferred for such period as the Minister may determine".

(d) Section 13 (7 )—

After section 13 (6), insert:—

(7) Where, pursuant to subsection (6), payment of con-

tributions, or part thereof, is deferred, interest on the amount so

deferred, at such rate as the Treasurer may approve, shall be
credited to the Renewal Reserve Account and debited to the

Working Account.

(2) Section 14—

Omit "(but not exceeding four per centum per annum)".

(1) (a) Section 2, definition of "Council"—

After "Local Government Act", insert ", 1919,".

(b) Section 2, definitions of "Local Government Act", "Prescribed"—

Omit the definitions.

(2) Section 3 (1) , ( 2 )—

Omit "permanent head of the Department" wherever occurring, insert instead "Director".

(3) (a) Section 5 (2), (3 )—

After "Local Government Act" wherever occurring, insert

", 1919".

(b) Section 5 (2 )—

Omit "of that Act".

(c) Section 5 (4)—

Omit the subsection.

(4) Section 7—

Omit "the Commissioner for Railways or any other", insert instead

"any".

(5) Section 12 (2) (b )—

Omit "Colonial" wherever occurring.

Omit "Colonial" wherever occurring.

(8) (a) Section 16 (1), (2) , (4) —

After "Local Government Act" wherever occurring, insert

(2) Section 41 of the Interpretation Act, 1897, applies in respect of a regulation as if this Act had been passed after the commence- ment of the Interpretation (Amendment) Act, 1969.
