Fish Resources Management Amendment

Regulations (No. 8) 2007

The amendments in these regulations are to the Fish Resources
Management Regulations 1995.

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Fish Resources Management
Amendment Regulations (No. 8) 2007.

2.            Commencement

These regulations comes into operation as follows:

(a)	regulations 1 and 2 — on the day on which this notice is published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

4.            Regulation 3 amended

Regulation 3(1) is amended by inserting in the appropriate alphabetical positions

"Kalbarri Blue Holes waters" means the waters of

the Kalbarri Blue Holes as defined in the Kalbarri
Blue Holes Fish Habitat Protection Area

Order 2007;

"motor boat" means a vessel propelled otherwise than

by oars or sail and includes a personal watercraft
within the meaning of the Navigable Waters
Regulations 1958;

5.            Part 9A amended

After Division 2 the following Division is inserted —

Division 3 — Kalbarri Blue Holes Fish Habitat

Protection Area

113C. Prohibited Behaviour

(1) A person must not fish in the Kalbarri Blue Holes
waters.
Penalty: $2 000 and the penalty provided in section 222

of the Act.

(2) A person must not use a motor boat in the Kalbarri
Blue Holes waters.
Penalty: $1 000.

6.            Schedule 12 amended

Schedule 12 Part 2 is amended as follows:

(a)	in item 3 by inserting after "113B(3)," —
" 113C(2), '';
(b)	in item 4 by inserting after "113B(1)," — " 113C(1)
