Fish Resources Management Amendment

Regulations (No. 6) 2014

Made by the Administrator in Executive Council.

1.             Citation

These regulations are the Fish Resources Management
Amendment Regulations (No. 6) 2014.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Fish Resources Management
Regulations 1995.

4.             Regulation 3 amended

In regulation 3(1) insert in alphabetical order:

Abalone Zone, followed by a number, means the zone
of that number described in Schedule 16;

5.             Regulation 38DA deleted

Delete regulation 38DA.

6.             Regulation 70 replaced

Delete regulation 70 and insert:

70.           Species prescribed (Sch. 5 and Act s. 103)

The species of fish described by a scientific name listed
in Schedule 5 column 1 are prescribed under
section 103 of the Act to be noxious fish in the area
described in Schedule 5 column 3 for the purposes of
the Act.

7.             Schedule 3 Part 6 amended

In Schedule 3 Part 6 in the Table in the item relating to
Abalone, Roe’s delete “20” and insert:

20 (including no more than 15 taken from Abalone Zone 1)

8.             Schedule 5 replaced

Delete Schedule 5 and insert:

Schedule 5 — Noxious fish

In this Schedule —

Montebello Islands Marine Park means all waters reserved
under the Conservation and Land Management Act 1984
section 13 as Class “A” Marine Reserve No. 9, Montebello
Islands Marine Park;

Port of Albany means the area described to be the Port of
Albany by order made by the Governor under the Port

Authorities Act 1999 section 24(1);

Port of Bunbury means the area described to be the Port of
Bunbury by order made by the Governor under the Port

Authorities Act 1999 section 24(1);

Port of Fremantle means the area described to be the Port
of Fremantle by order made by the Governor under the Port

Authorities Act 1999 section 24(1).
