Fish Resources Management Amendment Regulations (No. 5) 2024

Made by the Governor in Executive Council.

1.Citation

These regulations are the Fish Resources Management Amendment Regulations (No. 5) 2024.

2.Commencement

These regulations come into operation as follows —

  • (a)

    regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

  • (b)

    the rest of the regulations — on 1 December 2024.

3.Regulations amended

These regulations amend the Fish Resources Management Regulations 1995.

4.Regulation 3 amended
  • (1)

    In regulation 3(1) insert in alphabetical order:

     

Cockburn Sound means all waters bounded by a line commencing at a point at 32° 03.353′ south latitude and 115° 43.943′ east longitude (at the western extremity of the South Mole on the mainland); then extending north-westerly along the geodesic to a point at 32° 03.230′ south latitude and 115° 43.465′ east longitude (at the western extremity of the North Mole on the mainland); then south-westerly along the geodesic to a point at 32° 03.975′ south latitude and 115° 38.141′ east longitude (at Straggler Rocks); then south-easterly along the geodesic to a point at 32° 05.137′ south latitude and 115° 39.560′ east longitude (on Mewstone); then southerly along the geodesic to a point at 32° 07.125′ south latitude and 115° 39.818′ east longitude (on Carnac Island); then generally southerly along the high water mark of the eastern side of Carnac Island to a point at 32° 07.479′ south latitude and 115° 39.913′ east longitude (on Carnac Island); then southerly along the geodesic to a point at 32° 09.394′ south latitude and 115° 39.654′ east longitude (at Entrance Point on Garden Island); then generally southerly along the high water mark of the eastern side of Garden Island to a point at 32° 14.677′ south latitude and 115° 40.929′ east longitude (at South West Point on Garden Island); then southerly along the geodesic to a point at 32° 15.873′ south latitude and 115° 41.170′ east longitude (at John Point on the mainland); then generally northerly along the high water mark to the commencement point;

  • (2)

    In regulation 3(1) in the definition of Swan and Canning Rivers paragraph (a) delete “32° 03.23′” and insert:

     

32° 03.230′

5.Regulation 16E amended

In regulation 16E(3A), (3B) and (3C) before “the Swan and Canning Rivers;” (each occurrence) insert:

6.Schedule 2 Part 2 Division 5 Subdivision 1 clause 1 replaced

In Schedule 2 Part 2 Division 5 Subdivision 1 delete clause 1 and insert:

1. Blue swimmer (blue manna) crab

Blue swimmer (blue manna) crab taken or brought onto land, during the period beginning on 1 September in a year and ending on 30 November in that year, from —

  • (a)

    WA waters on the landward side of the 150 m isobath between 32° 03.23′ south latitude and 33° 27.11′ south latitude; or

  • (b)

    the Swan and Canning Rivers.

     
7.Schedule 3 Division 6 amended

In Schedule 3 Division 6 in the item for Crab, Blue Swimmer (Blue Manna) before “Swan” insert:

Cockburn Sound or the
