Fish Resources Management Amendment

Regulations (No. 4) 2009

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Fish Resources Management
Amendment Regulations (No. 4) 2009.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Fish Resources Management
Regulations 1995.

4.             Regulation 3 amended

In regulation 3(1):

(a) insert in alphabetical order:

complying drop net means a drop net that —

(a) is not more than 1.5 metres at its widest point; and
(b) is so constructed that when set —

(i)      its side or sides collapse so that its netting lies flat on the ground; and

(ii)      its netting is not capable of ensnaring or entangling a fish;

(b) in the definition of fishing net delete paragraph (c) and insert:

(c) a complying drop net;

5.             Regulation 40 amended

In regulation 40:

(a) in paragraph (a) before “drop” insert:

complying

(b) after each of paragraphs (a) and (b) insert:

or

6.             Regulation 64L amended

(1) In regulation 64L(1):
(a) delete paragraph (b) and insert:
(b) by using not more than 10 complying drop nets; or
(b) after paragraph (a) insert:

or

(2) After regulation 64L(2) insert:
(3A) The master of a boat which is not a licensed fishing
boat must not use, or cause or permit to be carried on
the boat, a drop net that is not a complying drop net.
