Fish Resources Management Amendment

Regulations (No. 3) 2019

Made by the Governor in Executive Council.

1.   Citation

These regulations are the Fish Resources Management

2.           Commencement

These regulations come into operation as follows -

(a) regulations 1 and 2—on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations - on the day after that day.

3.           Regulations amended

These regulations amend the Fish Resources Management
Regulations 1995.

4.            Regulation 3 amended

In regulation 3(1) insert in alphabetical order:

Geographe Bay and Inland Waters -

(a) means the waters bounded by a line
commencing at a point (the commencement
point) at 33° 27.11' south latitude and
1150 34.57' east longitude (on the mainland)

and extending -

(i)     west along the parallel to a point at 33° 27.11' south latitude and

1150 00.29' east longitude; then

(ii)     south along the meridian to a point at 33° 31.86' south latitude and

1150 00.29' east longitude (on the
mainland at Cape Naturaliste); then

(iii)     generally easterly along the high water mark to the commencement point;

and
(b) includes every river, estuary, inlet, constructed
waterway and their tributaries between Cape
Naturaliste and the commencement point;

Swan and Canning Rivers -

(a) means all waters of the Swan and Canning Rivers, including their tributaries, upstream of a line commencing at a point at 32° 03.353' south latitude and 115° 43.943' east longitude (at the westernmost point of South Mole, Fremantle) and extending to 32° 03.23' south latitude and
1150 43 .465' east longitude (at the westernmost

point of North Mole, Fremantle); and

(b) includes all waters of Rous Head Harbour;

5.            Regulation 16E amended

(I) In regulation 1 6E(3A):
(a) in paragraph (c) delete "or more";
(b) delete paragraph (c)(i) and insert:

(i)     3 days' bag limit of blue swimmer (blue manna) crabs in the Swan and Canning Rivers; and

(ia) 2 days' bag limit of blue swimmer (blue

manna) crabs in WA waters other than
the Swan and Canning Rivers; and

(c)

in paragraph (c)(v) delete "(combined)." and insert (combined);

(d) after paragraph (c) insert:

or

(d) if there are 4 or more persons on the boat -

(i)     4 days' bag limit of blue swimmer (blue manna) crabs in the Swan and Canning Rivers; and

(ii)     2 days' bag limit of blue swimmer (blue manna) crabs in WA waters other than the Swan and Canning Rivers; and

(iii)     2 days' bag limit of mud crabs (brown and green combined); and

(iv)     2 days' bag limit of cuttlefish, octopus and squid (combined); and

(v) 3 days' bag limit of rock lobster; and
(vi) 2 days' bag limit of brownlip and greenlip abalone (combined).
(2) In regulation 1 6E(3B):
(a) in paragraph (c) delete "or more";
(b) delete paragraph (c)(i) and insert:

(i)     3 days' bag limit of blue swimmer (blue manna) crabs in the Swan and Canning Rivers; and

(ia) 2 days' bag limit of blue swimmer (blue

manna) crabs in WA waters other than
the Swan and Canning Rivers; and

(c)

in paragraph (c)(v) delete "(combined)." and insert (combined);

(d) after paragraph (c) insert:

or

(d) if there are 4 or more persons on the boat -

(i)     4 days' bag limit of blue swimmer (blue manna) crabs in the Swan and Canning Rivers; and

(ii)     2 days' bag limit of blue swimmer (blue manna) crabs in WA waters other than the Swan and Canning Rivers; and

(iii)     2 days' bag limit of mud crabs (brown and green combined); and

(iv)     2 days' bag limit of cuttlefish, octopus and squid (combined); and

(v)     3 days' bag limit of rock lobster; and

(vi)     2 days' bag limit of brownlip and greenlip abalone (combined).

(3) In regulation 16E(3C):
(a) in paragraph (c) delete "or more";
(b) delete paragraph (c)(i) and insert:

(i)     3 days' bag limit of blue swimmer (blue manna) crabs in the Swan and Canning Rivers; and

(ia) 2 days' bag limit of blue swimmer (blue

manna) crabs in WA waters other than
the Swan and Canning Rivers; and

(c)

in paragraph (c)(v) delete "(combined)." and insert (combined);

(d) after paragraph (c) insert:

or

(d) if there are 4 or more persons on the boat -

(i)    4 days' bag limit of blue swimmer (blue manna) crabs in the Swan and Canning Rivers; and

(ii)    2 days' bag limit of blue swimmer (blue manna) crabs in WA waters other than

and squid (combined); and

(v)      3 days' bag limit of rock lobster; and

(vi)    2 days' bag limit of brownlip and greenlip abalone (combined).

6.            Schedule 2 Part 2 Division 5 amended

At the beginning of Schedule 2 Part 2 Division 5 insert:

Subdivision 1 — Protected by reference to species, area and

period

1.            Blue swimmer (blue manna) crab

Blue swimmer (blue manna) crab —

(a) taken or brought onto land from WA waters on the
landward side of the 150 m isobath between
32° 03.23' south latitude and 330 27.11' south
latitude during the period beginning on 1 September
in a year and ending on 30 November in that year;

Or

(b)

Canning Rivers during the period beginning on

taken or brought onto land from the Swan and in that year.

Subdivision 2 — Protected by reference to species length or other

factors

7.            Schedule 3 Division 6 amended

In Schedule 3 Division 6 delete the item relating to Crab, Blue

Swimmer (Blue Manna) and insert:

Crab, Blue Swimmer (Blue Manna) 5 (in Swan and Canning
Rivers)
10 (in Geographe Bay and
Inland Waters, including
no more than 5 females)
10 (in other waters of
West Coast region)
20 (in other regions)
