Fish Resources Management Amendment

Regulations (No. 2) 2003

Made by the Governor in Executive Council.

1.            Citation

These regulations may be cited as the Fish Resources
Management Amendment Regulations (No. 2) 2003.

2.            Commencement

These regulations come into operation on 1 March 2003.

3.            The regulations amended

The amendments in these regulations are to the Fish Resources
Management Regulations 1995* .

4.            Section 3 amended

Section 3(1) is amended as follows:

(a)

by deleting the full stop at the end of the definition of "sunset" and inserting instead a semicolon; and

(b)

by inserting in the appropriate alphabetical positions the following definitions

"eastern gulf land area" means the land adjacent to
the waters of the Shark Bay eastern gulf;

"Freycinet Estuary" means the waters of the Shark

Bay western gulf south of 26° 12' south latitude;

"waters of Shark Bay" means the waters of Shark

Bay lying south of a line drawn from Cape

"waters of the Shark Bay eastern gulf" means the

waters of Shark Bay south and east of a line
commencing at the high water mark of the
northernmost point of Cape Peron, from there due
north to the intersection with a line drawn due east
from the high water mark of the southernmost
point of Cape St Cricq, and from there due east to
the mainland, but not including the waters of

Denham Sound nor the Freycinet Estuary;

"waters of the Shark Bay western gulf" means the

waters of Shark Bay (including the waters of
Denham Sound and the Freycinet Estuary) south
of a line commencing at the high water mark of the
northernmost point of Withnell Point, from there
due east to the intersection with 113 degrees 15
minutes East longitude (WGS 84 Datum), from
there due north to the intersection with the
prolongation of the latitude that passes through the
high water mark of the northernmost point of Cape
Inscription, from there due east to the high water
mark of the northernmost point of Cape Peron (and
being enclosed on the eastern side by Peron
Peninsula and on the western side by Edel Land
Peninsula), then from the high water mark of the
northernmost point of Steep Point to the high
water mark on the south westernmost point of Surf
Point and east of Dirk Hartog Island.

5.            Regulation 19 amended

Regulation 19(1)(O is amended by deleting "(as those terms are defined in regulation 30D)".

6.            Regulation 30D repealed

Regulation 30D is repealed.
Regulation 30E amended
(1) Regulation 30E(2)(b) is amended by deleting "western gulf land
area." and inserting instead -

(2) Regulation 30E(5) is repealed.
8. Regulation 57 amended
Regulation 57(4) is repealed.

9.            Schedule 2 amended

(1) After the heading to Schedule 2 Part 2 Division 3 the following

is inserted -

Subdivision 1 - Protected by reference to species, area

and period

Pink Snapper

(a)

taken or brought ashore from the waters of the Shark Bay eastern gulf during the period beginning on 1 April in a year and ending on 31 July in that year; or

(b)

taken or brought ashore from the waters of the Freycinet Estuary during the period beginning on 15 August in a year and ending on 30 September in that year.

Subdivision 2 - Protected by reference to species and length

(2) Schedule 2 Part 2 Division 3 first Table is amended in the item

beginning "Snapper, Pink" by deleting paragraph (c) and inserting

instead -

(c) when taken or brought ashore

from the waters of Shark

Bay, other than in an area and

during a period referred to in

Subdivision 1 paragraph (a)

or in an area and during a

period referred to in

Subdivision 1 paragraph (b).. 500

(3) Schedule 2 Part 2 Division 3 second Table is amended by deleting the item beginning "Snapper, Pink" and inserting instead -
