Fish Resources Management Amendment

Regulations (No. 14) 2009

Made by the Lieutenant-Governor and deputy of the Governor in
Executive Council.

1.             Citation

These regulations are the Fish Resources Management
Amendment Regulations (No. 14) 2009.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on 15 October 2009.

3.             Regulations amended

These regulations amend the Fish Resources Management
Regulations 1995.

4.             Regulation 45 inserted

At the end of Part 4 Division 6 insert:

45.           Closed season for recreational fishing for demersal scalefish in West Coast Region

(1) In this regulation —
closed season means the period from 15 October to
15 December, both dates inclusive, in any year;
demersal scalefish means any fish listed in the Table.

(2) During the closed season a person must not —
(a) fish for demersal scalefish in the West Coast Region; or
(b) be in possession of demersal scalefish on a boat in the waters of the West Coast Region; or
(c) bring onto land in the West Coast Region any demersal scalefish.

Penalty: For a first offence a fine of $5 000 or, for a second or subsequent offence, a fine of $10 000 and, for any offence, the penalty provided in

section 222 of the Act.

(3) Subregulation (2) does not apply to or in respect of
demersal scalefish taken for a commercial purpose in
accordance with an authorisation.

5.             Regulation 156 amended

In regulation 156 in the Table after “41,” insert:

6.             Regulation 157 amended

In regulation 157(1)(a) delete “$15” and insert:
