Fish Resources Management Act 1994
Fish Resources Management Amendment
Regulations 2019
Made by the deputy of the Governor in Executive Council.
1. Citation
These regulations are the Fish Resources Management
Amendment Regulations 2019.
2. Commencement
These regulations come into operation as follows —
(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day.
3. Regulations amended
These regulations amend the Fish Resources Management
Regulations 1995.
4. Regulation 3 amended
In regulation 3(1) insert in alphabetical order:
charter boat means a boat that is used to conduct a
fishing tour for a commercial purpose in accordance
with a fishing tour operator’s licence or a restricted
fishing tour operator’s licence;

5. Regulation 12 amended
In regulation 12(1) and (2) delete “totally protected fish that is a
rock lobster” and insert:rock lobster that is either a totally protected fish or a
commercially protected fishNote: The heading to amended regulation 12 is to read: Certain protected rock lobsters and crabs to be released
6. Regulation 14 amended
In regulation 14(1) delete the Table and insert:

9. Regulation 32 amended
Delete regulation 32(1)(b)(ii) and insert:
(ii) in the case of a pot set or pulled under the authority of a managed fishery licence granted in respect of the West Coast Rock Lobster Managed Fishery, the number of the managed fishery licence; or
(iii) in the case of a pot set or pulled by a
person participating in a fishing tour —
(I) if the fishing tour is conducted
by the holder of a fishing touroperator licence — the letters
“F.T.O.” followed by the
operator’s licence number; or
(II) if the fishing tour is conducted
by the holder of a restrictedfishing tour operator licence — the letters “R.F.T.O.” followed
by the operator’s licence number;
or
(iv) in the case of a pot set or pulled other than in the circumstances mentioned in subparagraph (i), (ii) or (iii), the gear identification number of the person setting or pulling the pot;

10. Regulation 35 amended
In regulation 35:
(a) in paragraph (c)(ii) delete “consumption.” and insert: consumption;
(b) after paragraph (c) insert: or
(d) the part was separated from a whole rock lobster at the person’s principal place of
residence and —
(i) if the part is a tail — it is stored at that
place with its shell, and tail clip or tail punch as required under regulation 31, remaining intact; or
(ii) if the part is other than a tail — it is
stored at that place.
11. Regulation 36 amended
After regulation 36(2A) insert:
(2B)
Subregulation (1)(b) does not apply in respect of a person who is on board a boat that is specified on a
fishing tour operator’s licence, or a restricted fishing tour operator’s licence, granted under regulation 128J and is —
(a) a participant of a fishing tour; or (b)
a master, or a member of the crew, of the boat during a fishing tour.

12. Regulation 38DB inserted
At the beginning of Part 4 Division 5B insert:
38DB. Term used: fishing season In this Division — fishing season means —
(a) for Abalone Zone 1, between 7 am and 8 am on the second Saturday in January, the first and third Saturdays in February and the second Saturday in December in any year; and (b) for Abalone Zones 2 and 3, the period beginning on 1 October in any year and ending on 15 May in the following year.
13. Regulation 38D amended
Delete regulation 38D(1).
14. Regulations 38EA and 38EB inserted
After regulation 38E insert:
38EA. Possession of fishing gear in Abalone Zone outside
fishing season
(1) A person must not, in Abalone Zone 1, 2 or 3, be in
possession of any fishing gear capable of being used to
take abalone at any time other than during the fishing
season for that Abalone Zone.Penalty for this subregulation: a fine of $5 000.

(2) Subregulation (1) does not apply to a person who —
(a)
is authorised to take abalone for a commercial purpose under an authorisation; or
(b)
has a reasonable excuse for being in possession of the fishing gear.
38EB. Possession of abalone
(1) A person must not, in Abalone Zone 1, 2 or 3, be in possession of abalone unless the person —
(a)
holds a recreational fishing licence authorising the person to fish for abalone; and
(b)
is fishing during the fishing season for that Abalone Zone or in possession of the abalone during the period of 12 hours commencing immediately after that fishing season.
Penalty for this subregulation: a fine of $5 000 and the
penalty provided in section 222 of the Act.
(2) Subregulation (1) does not apply to a person who is authorised to take abalone for a commercial purpose under an authorisation.
15. Regulation 44A deleted
Delete regulation 44A.
16. Regulation 45 amended
In regulation 45(1) in the definition of demersal scalefish delete

17. Regulation 61 amended

(a) if the rock lobster was taken under the authority of a managed fishery licence granted in respect of the West Coast Rock Lobster Managed Fishery — the number of the managed fishery

(b) the following —
(i) the licensed fishing boat number of any licensed fishing boat which was used to fish for the fish;

18. Regulation 64 amended
Delete regulation 64(6a) and insert:
(6A) A person who conducts a fishing tour on a boat must
ensure that a record to be kept under this regulationexists or is made —
(a) for, and by the end of, each day the fishing tour is conducted; and (b) before any participant in the fishing tour leaves the tour.
19. Regulation 64AA amended
(1) In regulation 64AA(1) insert in alphabetical order: exempt business means a business of providing
accommodation and meals to the public.
(2) In regulation 64AA(1) in the definition of commercial premises delete “regulation 64(2)(d) to (i).” and insert: regulation 64(2)(d) to (i);

(3) In regulation 64AA(2) delete the Penalty and insert: Penalty for this subregulation:
(a) for an individual — a fine of $5 000 and the penalty provided in section 222 of the Act;
(b) for a body corporate — a fine of $10 000 and the penalty provided in section 222 of the
Act.
(4) After regulation 64AA(2) insert: (2A) Subregulation (2) does not apply to or in relation to a
fish that is at commercial premises at which an exempt
business is conducted.(2B) A person must not cause or permit a fish that was taken
by recreational fishing to be brought onto or stored atcommercial premises unless —
(a)
the person conducts an exempt business at the premises; and
(b)
the fish, or the package containing it, is labelled in accordance with regulation 22(2); and
(c)
the person whose name is on the label is staying in accommodation provided by the exempt business; and
(d)
the fish is not stored in a refrigerator, freezer, icebox or other storage container that contains a fish taken for a commercial purpose.
Penalty for this subregulation:
(a) for an individual — a fine of $5 000 and the penalty provided in section 222 of the Act;

(b) for a body corporate — a fine of $10 000 and the penalty provided in section 222 of the
Act.
(5) In regulation 64AA(3) after “subregulation (2)” insert: or (2B) 20. Regulation 64L amended
Delete regulation 64L(1A).
21. Regulation 64W amended
(1) In regulation 64W delete “It is a defence” and insert: (1) It is a defence (2) In regulation 64W(c) delete “land.” and insert: land; or (3) At the end of regulation 64W insert:
(d) for the person charged with taking, or bringing onto land, on any one day more fish than the bag limit of those fish to prove that —
(i) the person was fishing from a boat; and

(ii) at the time the fish were taken, or brought onto land, the person was acting in accordance with 1 of the following
authorities to fish for the fish —
(I)
a recreational fishing licence granted under regulation 124;
(II) a recreational (boat) fishing
licence granted under
regulation 124C;
and
(iii) the quantity of fish taken, or brought onto land, using the boat did not exceed the combined bag limit for the boat in relation to the fish calculated under subregulation (2).
(2) For the purposes of subregulation (1)(d)(iii), the
combined bag limit for a boat in relation to a fish is
calculated by multiplying the bag limit for the fish bythe number of persons who on the day —
(a) are fishing from the boat; and (b) hold a recreational fishing licence or the persons to fish for the fish.

23. Regulation 123 amended

recreational fishing licence if the person is —

25. Regulation 128MA amended
After regulation 128MA(1)(a) insert:
(aa) that each boat used in connection with a fishing tour conducted under the licence must be a boat that is specified on the licence under regulation 128J(2)(g);

are WA waters off the western coast of WA that are between21° 44′ south latitude and 34° 24′ south latitude.
(2A) Subclause (2) does not apply to a rock lobster pot used in
waters mentioned in subclause (1)(a).(2) Delete Schedule 13 clause 3(5) and insert:
(5) Each escape gap required under this clause must be, as
nearly as practicable, rectangular in shape.(5A) When measured internally, each escape gap required under
this clause must measure not less than 305 mm in lengthand —
(a) if the rock lobster pot is used under the authority of a managed fishery licence granted in respect of the West Coast Rock Lobster Managed Fishery —
55 mm in height; or
(b) otherwise — 54 mm in height.
