FISH RESOURCES MANAGEMENT AMENDMENT REGULATIONS 1998

Made by the Governor in Executive Council.
Citation

1. These regulations may be cited as the Fish Resources Management Amendment

Regulations 1998.

Principal regulations

2. In these regulations the Fish Resources Management Regulations 1995* are referred

to as the principal regulations.

Regulation 41 amended

3.  Regulation 41 of the principal regulations is amended —

(a)	after the regulation designation "41." by inserting the subregulation designation "(1)";
(b)	by deleting "A person," and substituting the following — " Subject to subregulation (2), a person, "; and

(c) by inserting after subregulation (1) the following subregulation and Table —

(2) Subregulation (1) (a) does not apply to a person if that person —

(a)	removes an abalone from its shell, or permits an abalone to be removed from its shell, within an area described in the Table to this regulation; and
(b)	immediately takes the abalone from which the shell has been removed from that area to an area which is more than 200 metres on the landward side of the high water mark.

The fish cleaning facility situated approximately 40 metres in an easterly direction from the intersection of Wharton Road and Road No. 17027 (access road to the Duke of Orleans Caravan Park) at the

4.    Regulation 152 (2) (b) of the principal regulations is amended by deleting" 25° 56.90919" "

and substituting the following —
" 25° 56.90919' ".
Schedule 2 amended

5.   Schedule 2, Part 2, Division 2 to the principal regulations is amended by inserting

after the item "Great White Shark." the following item —

" Humphead Maori Wrasse ".

Schedule 3 amended

6.   Schedule 3, Part 1 to the principal regulations is amended by inserting after the item

commencing "Barramundi" the following item —

" Bonito, Leaping and Oriental	8 ".
Schedule 7 amended

7.   Schedule 7 to the principal regulations is amended in the Part headed "MARINE OR

FLUVIO-MARINE FISH" —

(a) by inserting after the item commencing "Billfish" the following items — "

Bonito, Leaping	Cybiosarda elegans
Bonito, Oriental	Sarda orientalis

and

(b)	by inserting after the general item commencing "Wrasse" the following item —
" Wrasse, Humphead Maori Cheilinus undulatus ".
