FISH RECEIVER PERMITS DECLARATION 2017

I NICK RAYNS  A/g Chief Executive Officer of the Australian Fisheries Management Authority (AFMA), as Delegate of AFMA by instrument of delegation from the Commission dated 14th November 2016 and numbered No 2 of 2016 , make the following declaration under sub section 91(1) of the Fisheries Management Act 1991.

Name of Declaration

  1. This declaration is the Fish Receiver Permits Declaration 2017.

Note 1: Section 91(1)of the Fisheries Management Act 1991 provides for publication of this notice in the Gazette. However, sub-section 56(1) of the Legislation Act 2003.provides “… the requirement is taken to be satisfied if the instrument is registered as a legislative instrument…” (unless the Gazettal is additionally required to registration by amendment after 1st January 2005).

Commencement

  1. This declaration commences the day after it is registered on the Federal Register of Legislation.

Note 1: Section 91(1)of the Fisheries Management Act 1991 provides for publication of this notice in the Gazette. However, sub-section 56(1) of the Legislation Act 2003.provides “… the requirement is taken to be satisfied if the instrument is registered as a legislative instrument…” (unless the Gazettal is additionally required to registration by amendment after 1st January 2005).

Cessation

3.       This Declaration is repealed on 1st July 2026 unless earlier revoked.

Definitions

  1. In this declaration:

Bass Strait Central Zone Scallop Fishery means the fishery defined in the Bass Strait Central Zone Scallop Fishery Management Plan 2002.

Coral Sea Fishery means commercial fishing authorised by a fishing permit in the area defined in Part 2 of Schedule 1A of the Fisheries Management Regulations 1992.

Eastern Tuna and Billfish Fishery means the fishery defined in the Eastern Tuna and Billfish Fishery Management Plan 2010.

Norfolk Island Offshore Demersal Finfish Fishery means commercial fishing authorised by a fishing permit in the area defined in Part 5A of Schedule 1A of the Fisheries Management Regulations 1992.

Small Pelagic Fishery means fishing authorised by a fishing permit in the area defined in the Small Pelagic Fishery Management Plan 2009.

Southern and Eastern Scalefish and Shark Fishery means the fishery defined in the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

Southern Bluefin Tuna Fishery means the SBT fishery defined in the Southern Bluefin Tuna Fishery Management Plan 1995.

Southern Squid Jig Fishery means the fishery defined in the Southern Squid Jig Fishery Management Plan 2005.

Western Tuna and Billfish Fishery means the fishery defined in the Western Tuna and Billfish Fishery Management Plan 2005.

Note 2   Unless otherwise stated, a term used in this declaration and in the Fisheries Management Act 1991 has the same meaning in this declaration as in the Fisheries Management Act 1991.

Declaration

  1. The Bass Strait Central Zone Scallop Fishery, Coral Sea Fishery, Eastern Tuna and Billfish Fishery, Norfolk Island Offshore Demersal Finfish Fishery, Small Pelagic Fishery, Southern and Eastern Scalefish and Shark Fishery, Southern Bluefin Tuna Fishery, Southern Squid Jig Fishery, and Western Tuna and Billfish Fishery are fisheries to which Division 2 (Fish Receiver Permits) of Part 6 of the Fisheries Management Act 1991 applies.

Revocation

  1. The Fish Receiver Permits Declaration 2007 is revoked.
