[ASSENTED TO 17TH OCTOBER, 1935.] B E it enacted by the King's Most Excellent Majesty) by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows;- Short title I. This Act may be cited as "The Fish and Oyster : ~ ~ struction. Acts Amendment Act of 1935," and shall be read as one with *" The Fish and Oyster Acts, 1914 to 1932," herein referred to as the Principal Act. The Principal Act and this Act may be collectively cited as " The Fish and Oyster Acts, 1914 to 1935." Amendment of B. 44. 2. Subsection six of section forty-four of the Principal Act is deleted. * 5 Geo. V. No. 23, 9 Geo. V. No. 14, and 23 Geo. V. No. 30, 8upra, pages 6224, 8489, and 14140.

The following new section 44A is inserted after New 8. 44A. section forty-four of the Principal Act, as follows:- "[44A.] It is unlawful to have in possession in Unlawf~ Queensland any fish which has been taken by means of~ ~ : ~ ~ Z~ n explosive, poisonous, or other noxious substance. In Q ueens 1 an d 0 f any suc h f & lX c p . !OSlves, fish shall be guilty of an offence against this Act and liable to a penalty not exceeding fifty pounds, and any inspector may seize all such fish. For the purpose of this section the averment in any complaint that any fish has been taken by means of explosive, poisonous, or other noxious substance shall be sufficient evidence of that fact unless and until the contrary js proved."
