DAWSON J:   This matter, which was considered by Justices Gaudron, McHugh and myself, has been reopened and reconsidered on the motion of the applicant. The point which the applicant seeks to argue on appeal cannot result in orders in his favour under Division 3, Part VIA of the Industrial Relations Act 1988 (Cth) as sought in his originating process.
