First State Superannuation Act 1992

MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 7 of the First State Superannuation Act 1992, make the following Order.

Explanatory note
The object of this Order is to include Port Botany Operations Pty Limited (as trustee of the Port Botany Unit Trust) and Port Kembla Operations Pty Limited (as trustee of the Port Kembla Unit Trust) in the list of employers in Schedule 1 to the First State Superannuation Act 1992. This will mean that certain employees of Sydney Ports Corporation whose employment is transferred to Port Botany Operations Pty Limited (as trustee of the Port Botany Unit Trust), and certain employees of Port Kembla Port Corporation whose employment is transferred to Port Kembla Operations Pty Limited (as trustee of the Port Kembla Unit Trust), will continue to be employees for the purposes of the Act.

This Order is made under section 7 of the First State Superannuation Act 1992.

This Order commences on the day on which it is published on the NSW legislation website.

Schedule 1 Employers

Insert at the end of the Schedule:

Port Botany Operations Pty Limited (as trustee of the Port Botany Unit Trust), limited to those employees whose employment is transferred from Sydney Ports Corporation to Port Botany Operations Pty Limited (as trustee of the Port Botany Unit Trust) by order under section 16 of the Ports Assets (Authorised Transactions) Act 2012
