I, Professor The Honourable Dame Marie Bashir AD CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 7 of the First State Superannuation Act 1992, make the following Order.

Explanatory note
The object of this Order is to include AGL Macquarie Pty Limited in the list of employers in Schedule 1 to the First State Superannuation Act 1992. This will mean that employees of Macquarie Generation whose employment is transferred to AGL Macquarie Pty Limited following the sale by Macquarie Generation to AGL Macquarie Pty Limited of the Macquarie Generation business will continue to be employees for the purposes of the Act.
This Order is made under section 7 of the First State Superannuation Act 1992.

3 Amendment of First State Superannuation Act 1992 No 100

Schedule 1 Employers

Insert at the end of the Schedule:

AGL Macquarie Pty Limited, limited to those employees whose employment is transferred from Macquarie Generation to AGL Macquarie Pty Limited pursuant to offers of employment made under the Sale and Purchase Agreement dated 12 February 2014 between Macquarie Generation and AGL Macquarie Pty Limited
