FIRST STATE SUPERANNUATION ACT 1992—ORDER

NEW SOUTH WALES

I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 7 of the First State Superannuation Act 1992, do, by this my Order:

(a)

amend Schedule 1 to that Act (Employers), to take effect on and from 24 February 1995, by inserting at the end of Part 1 of that Schedule the following names:

Jemalong Wyldes Plains Irrigation Limited
Lower Murray Irrigation Areas Limited
Murray Irrigation Limited

(b)

amend Schedule 1 to that Act (Employers), to take effect on and from 3 March 1995, by omitting the following names:

Jemalong Wyldes Plains Irrigation Limited
Lower Murray Irrigation Areas Limited
Murray Irrigation Limited
Treasurer.

EXPLANATORY NOTE

Under the First State Superannuation Act 1992, employers within the meaning of the Act are required to make superannuation contributions to the First State Superannuation Fund in respect of certain of their employees. Schedule 1 to the Act lists organisations and bodies that are employers for the purposes of the Act. Section 7 of the Act authorises the Governor-in-Council, by order, to amend the Schedule of employers.

The purposes of this Order are:

to include three irrigation corporations—Jemalong Wyldes Plains Irrigation Limited, Lower Murray Irrigation Areas Limited and Murray Irrigation Limited—in the Schedule of employers. These irrigation corporations became State owned corporations (under the State Owned Corporations Act 1989) on 24 February 1995; and
to remove the names of the same three irrigation corporations from the list of employers, effective one week later. The removal of the names is a necessary consequence of the privatisation of the corporations (under the Irrigation Corporations Act 1994) on 3 March 1995.

The effect of the Order is to require the named employers to make contributions in respect of their employees for the period between 24 February 1995 and 3 March 1995. (Section 7 (2) of the Act authorises an amending Order to be made so that it has effect on and from a date that is earlier than the date of its publication).
