FIRST STATE SUPERANNUATION ACT 1992—ORDER

NEW SOUTH WALES

I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 7 of the First State Superannuation Act 1992, do, by this my Order:

(a)

amend Part 1 of Schedule 1 to that Act (Employers) by omitting the following names:

The Director-General of New South Wales Fire Brigades

New South Wales Meat Industry Authority

Forestry Commission

Public Trust Office

WorkCover Authority

Department of Local Government and Co-operatives

Royal Botanic Gardens and Domain Trust

(b)

amend Part 1 of that Schedule, to take effect on and from 8 December 1992, by omitting the item relating to Trustees of state recreation areas and by inserting instead the following names:

Trustees of Arakoon State Recreation Area
Trustees of Bent’s Basin State Recreation Area
Trustees of Burrendong State Recreation Area
Trustees of Burrinjuck State Recreation Area
Trustees of Copeton State Recreation Area
Trustees of Lake Glenbawn State Recreation Area
Trustees of Grabine State Recreation Area
Trustees of Lake Keepit State Recreation Area

amend Part 1 of that Schedule, to take effect on and from 8 December 1992, by inserting at the end of that Part the following name:

amend Part 2 of that Schedule, to take effect on and from 8 December 1992, by inserting at the end of that Part the following names:

Local Government Electricity Association of New South Wales
Health Services Association of New South Wales
Institute of Municipal Management
New South Wales Nurses’ Association
State Sports Centre Trust

Sydney Cricket and Sports Ground Trust

(e)

amend Part 2 of that Schedule, to take effect on and from 8 December 1992, by inserting after the item relating to the Sydney Cricket and Sports Ground Trust the following names and limitation:

Government Employees (limited to persons who were
Health Club employees of the employer
Keep Australia Beautiful on 7 December 1992)
Sydney Credit Union
(f) amend Part 2 of that Schedule, to take effect on and from 8 December 1992, by omitting the following items:

The employer of a servant, or class of servants, specified in a proclamation published under section 2 (4) of the Local Government and Other Authorities (Superannuation) Act 1927

A body or association of persons specified in a proclamation published under section 2 (5) of the Local Government and Other Authorities (Superannuation) Act 1927

(g)

amend Part 2 of that Schedule, to take effect on and from 1 July 1993, by omitting from that Part the figure “1919” where firstly occurring and by inserting instead the figure “1993”;

(h)

amend Part 2 of that Schedule, to take effect on and from 1 July 1993, by omitting from that Part the matter “A committee constituted under the Local Government Act 1919 as an urban committee or a joint committee of 2 or more councils and by inserting instead the following matter:

An electricity distributor within the meaning of the Electricity

Act 1945

(i)  amend Part 2 of that Schedule, to take effect on and from 1 July 1993, by inserting after the item relating to the Sydney Credit

Union the following names:

EXPLANATORY NOTE

The object of this Order is to bring Schedule 1 to the First State Superannuation Act 1992 up to date. The Schedule lists organisations and bodies that are employers for the purposes of the Act and as such are required to make superannuation contributions to the First State Superannuation Fund in respect of certain of their employees.

The amendments:

(a) reflect the current names or descriptions of employers; and
(b) add the names of certain other employers; and
(c) remove the names of certain employers that no longer exist.

Section 7 of the Act authorises the Governor-in-council, by order, to amend the Schedule for such purposes. Where appropriate, the Order will have retrospective effect from the date on which the relevant change or addition occurred or took effect. (Subsection (2) of the section authorises an order to be made so that it has effect retrospectively.)
