Firefighters' Presumptive Rights Compensation Amendment Regulations 2022

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Firefighters' Presumptive Rights Compensation Regulations 2019 as a consequence of the enactment of Part 5 of the Workplace Safety Legislation and Other Matters Amendment Act 2022 which amends the Firefighters' Presumptive Rights Compensation and Fire Services Legislation Amendment (Reform) Act 2019 to extend presumptive rights to vehicle and equipment maintenance employees.

2Authorising provision

These Regulations are made under section 22 of the Firefighters' Presumptive Rights Compensation and Fire Services Legislation Amendment (Reform) Act 2019.

3Commencement

These Regulations come into operation on 1 September 2022.

4Principal Regulations

In these Regulations, the Firefighters' Presumptive Rights Compensation Regulations 2019[1] are called the Principal Regulations.

5Amendment of objectives

In regulation 1(c) of the Principal Regulations, after "sections 12" insert ", 12C".

6Definitions

In regulation 3 of the Principal Regulations, in the definition of expert opinion, after "section 12" insert ", 12C".

7Request for expert opinion from the advisory committee

In regulation 12(1) of the Principal Regulations, after "section 12(1)" insert ", 12C(1)".

8Expert opinions

(1)In regulation 14(1)(a) and (b) of the Principal Regulations, after "firefighter" insert "or vehicle and equipment maintenance employee".

(2)In regulation 14(2) and (5)(a) of the Principal Regulations, after "section 12" insert "or 12C".

(3)In regulation 14(7) and (8) of the Principal Regulations, after "firefighter" insert "or vehicle and equipment maintenance employee".
