Firearms Amendment Regulations 2023

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Firearms Amendment

Regulations 2023.

2.              Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3.             Regulations amended

category D firearm

These regulations amend the Firearms Regulations 1974.

4.             Regulation 6A amended

In regulation 6A(3) delete "firearm of category D" and insert:

category D firearm

5.             Regulation 25 amended

In regulation 25 in the Table items 1, 3 and 4 delete "firearm of category D" and insert:

6.            Regulation 26 amended

(1)	In regulation 26(1) delete "(2a)," and insert:
(2A),
(2)	Delete regulation 26(2a) and insert:

(2A) This regulation does not apply to a category D firearm

if

(a)	the firearm is named and identified in a licence issued to a Government department, State instrumentality or agency of the Commonwealth approved under section 16D of the Act; and
(b)	what is done is in accordance with the licence.

(3)	In regulation 26 in the Table delete "a firearm of category D" and insert:
a category D firearm

7.           Regulation 26B amended

(1) In regulation 26B(2):

(a) in paragraph (d) delete "rifle." and insert:

rifle; or

(b) after paragraph (d) insert:

(e) except as provided in subregulation (5), the
firearm is a category D firearm.

(2)	After regulation 2613(4) insert:
(5) Subregulation (2)(e) does not prevent a licence, permit or approval of a category D firearm being issued, granted or given to a Government department, State instrumentality or agency of the Commonwealth approved under section 16D of the Act.

8.            Schedule 3 clause 8 replaced

Delete Schedule 3 clause 8 and insert:

8.             Genuine need test for category D

To satisfy the genuine need test for category D the applicant must —

(a)	be a Government department, State instrumentality or agency of the Commonwealth approved under section 16D of the Act; and
(b)	satisfy the Commissioner that the firearm is required for State or Commonwealth government purposes.
