Firearms Amendment (Law Revision)

Regulation 2011

Firearms Act 1996

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Firearms Act 1996.

Explanatory note
The objects of this Regulation are:

(a) to repeal a spent provision that prevented licensed shooters who surrendered, and received compensation for, their pistols from getting a category H (sport/target shooting) licence for a 5-year period which has now ended, and
(b) to repeal a spent provision that established a temporary amnesty for the surrender of barrels and ammunition, and
(c) to update references to certain legislation.

This Regulation is made under the Firearms Act 1996, including section 88 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Firearms Amendment (Law Revision) Regulation
2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Firearms Regulation 2006

(1) Clause 5 Offences that disqualify applicants

Omit “Poisons and Therapeutic Goods Regulation 2002” from clause 5 (1) (b).

Insert instead “Poisons and Therapeutic Goods Regulation 2008”.

(2) Clauses 118 and 133
Omit the clauses.
(3) Clause 121 Apprehended violence orders and interim apprehended
violence orders of other jurisdictions
Omit “an intervention order under the Crimes (Family Violence) Act
1987” from clause 121 (1) (f).
Insert instead “a family violence intervention order under the Family
Violence Protection Act 2008”.
(4) Clause 121 (1) (i)
Omit “restraining order under the Domestic Violence Act”.
Insert instead “domestic violence order under the Domestic and Family
Violence Act”.
