FIREARMS AMENDMENT

ACT 1994

AN ACT to amend the Firearms Act 1973.

[Assented to 5 January 1995.]

The Parliament of Western Australia enacts as follows:

Short title

1. This Act may be cited as the Firearms Amendment Act 1994.

Commencement

2.     This Act comes into operation on the day on which it

receives the Royal Assent.

Principal Act

3. In this Act the Firearms Act 1973* is referred to as the

principal Act.

Section 20 amended

4.     Section 20 (1) of the principal Act is amended by inserting

after paragraph (a) the following paragraph —

(aa) that harm may be suffered by any person as a result of a person retaining or regaining possession of a firearm;

Section 24 amended

5.     Section 24 (2) of the principal Act is repealed and the

following subsection is substituted —

(2) A member of the Police Force may, without

warrant, seize and take possession of any firearm or

ammunition that is in the possession of a person

licensed or otherwise authorized to possess it if, in the

opinion of the member of the Police Force —

(a)

possession of it by that person may result in harm being suffered by any person; or

(b)

that person is not at the time a fit and

proper person to be in possession of it.
