His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Firearms Act 1996.

Explanatory note

Clause 118 of the Firearms (General) Regulation 1997 currently authorises an amnesty enabling the lawful sale to or through licensed firearms dealers of firearms owned by existing licence or permit holders (ie those persons whose licence or permit under the Firearms Act 1989 has been continued, and who have applied for, but are refused, a new licence or permit under the Firearms Act 1996). The existing licence or permit holder must take the firearms to a licensed dealer within 21 days of receiving notice of the refusal of the new licence or permit.

The object of this Regulation is to provide that, during the period when the existing licence or permit holder is subject to the amnesty under clause 118, the person is also exempt from the offence provisions under the Act that relate to the sale and possession of unregistered firearms.

This Regulation is made under the Firearms Act 1996, including section 88 (the general regulation-making power, in particular section 88 (2) (r)).

This Regulation is the Firearms (General) Amendment (Temporary
Registration Amnesty) Regulation 1999.

Schedule 1.

Clause 93A

Insert after clause 93:

93A Temporary registration amnesty
(1) This clause applies to any person to whom an exemption

referred to in clause 118 applies.

(2) A person to whom this clause applies does not, during the period when such an exemption applies in relation to the person, commit an offence under section 36 of the Act in respect of the sale or possession of an unregistered firearm to which the person's existing licence or existing permit related.

(3) This clause has effect despite any other clause of this

Regulation.
