FIREARMS ACT 1989—REGULATION

(Relating to a firearms amnesty)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Firearms Act 1989, has been pleased to make the Regulation set forth hereunder.

The Firearms Regulation 1990 is amended by omitting clause 98 and by inserting instead the following clause:

Temporary amnesty for surrender of firearms

98. (1) A person is exempt from any requirement of the Act to hold a licence or permit authorising possession of a firearm or ammunition, but only for the following purposes:

(a)

surrendering the firearm or ammunition to the Commissioner of Police by delivering it, in accordance with such guidelines as may be fixed by the Commissioner with the approval of the Minister, to any police station or other place nominated by the Commissioner for the purpose;

(b)

proceeding to a police station or other nominated place for the purpose of surrendering the firearm or ammunition as referred to in paragraph (a).

(2) Nothing in this clause authorises the use of a firearm.
(3) Ths clause ceases to operate at the end of 30 June 1996.

EXPLANATORY NOTE

This Regulation substitutes an existing provision of the Firearms Regulation 1990 that enabled the Minister to declare by order an amnesty for firearms and ammunition that would allow their surrender to the Police or transfer to a person who held an appropriate licence or permit. The new provision provides for an amnesty in substantially the same terms as the existing provision except that the new amnesty will only allow the surrender of firearms and ammunition to the Police, and the amnesty will be created directly by the regulation (rather than by empowering the Minister to declare the amnesty by order).

This Regulation is made under the Firearms Act 1989, in particular section 56 (2) (i).
