Firearms Amendment (Prohibition of
Sales) Regulation 1996

Firearms Act 1989
His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Firearms Act 1989.

Explanatory note
The object of this Regulation is to provide that shooter licences (class 1 or 2), and firearm dealers’ licences, are subject to the condition that the holder of any such licence must not sell or give possession of any of the following types of firearms to another person (unless the firearm is being surrendered to the police):
• self-loading centre-fire rifles fitted with an integral or a detachable
magazine,• self-loading rimfire rifles,
• self-loading shotguns fitted with an integral or a detachable magazine, The breach of any such condition by a licensed shooter or fiream dealer constitutes an offence under the Firearms Act 1989.

This Regulation is made under the Firearms Act 1989, including sections
21 (3) and 56 (the general regulation making power).

1 Name of Regulation
This Regulation is the Firearms Amendment (Prohibition of
Sales) Regulation 1996.
2 Amendment of Firearms Regulation 1990
The Firearms Regulation 1990 is amended as set out in Schedule
1.

Clause 27A
Insert after clause 27:
27A Sale of certain firearms subject to licence condition
(1)
For the purposes of section 21 (3) of the Act, any shooter licence class—l, -shooter licence class—2 or firearms dealer licence is subject to the condition that the holder of the licence must not sell or give possession of any of the following firearms to another person:
(a)
a self-loading centre-fire rifle fitted with (or capable of being fitted with) an integral or a detachable magazine,
(b) a self-loading rimfire rifle, (c)
a self-loading shotgun fitted with (or capable of being fitted with) an integral or a detachable magazine,
(d) a pump action shotgun.

(2)
Subclause (1) does not apply in respect of the holder of a licence who gives possession of any such firearm to a police officer for the purposes of surrendering the firearm to the police officer.
