3 Fire Service Amendment (No. 1) No. 189, 1993 ˙ Short title 1. This regulation may be cited as the Fire Service Amendment Regulation (No. 1) 1993 . ˙ Amended regulation 2. The Fire Service Regulation 1990 is amended as set out in this regulation. ˙ Replacement of s.2 (Interpretation) 3. Section 2— omit, insert— ˙ ‘Definitions ‘2. In this regulation— “community protection centre” includes ambulance centre, fire station, State Emergency Service headquarters, Air Sea Rescue station and Coast Guard centre; “licensed” , in relation to premises that are used other than as an oil or fuel depot, means premises for which a licence has been issued under the Liquor Act 1992 to sell liquor; “outdoor storage area” includes an area used as a builder’s or contractor’s yard, a garden materials storage centre, a fenced area for parking or storage (other than for retail sale) of heavy equipment, materials, motor vehicles and boats; “premises” includes— (a) land; and (b) a building or structure in or on land; in a local authority area but does not include— (c) a hotel; or (d) a motel; or (e) an office; or

4 Fire Service Amendment (No. 1) No. 189, 1993 (f) a shop; or (g) a commercial recreation premises; “students” includes full time and part time students (other than external students); “tavern” means a premises in relation to which a general licence has been issued under the Liquor Act 1992 . ’. ˙ Replacement of s.4 (Forms) 4. Section 4— omit, insert— ˙ ‘Prescribed forms ‘4.(1) The forms to be used for the purposes of the Act are the forms approved by the Commissioner. ‘(2) A person may request the Commissioner to give the person a document setting out a form approved under subsection (1). ‘(3) The Commissioner must comply promptly with a request under subsection (2). ’. ˙ Insertion of new ss.10–15 5. After section 9— insert— ˙ ‘Constitution of urban districts ‘10.(1) The portions of the State mentioned in column 1 of Schedule 1 are constituted as urban districts. ‘(2) The boundaries of each of the urban districts mentioned in column 1 of Schedule 1 are those in the corresponding map delineated in column 2 of Schedule 1. ˙ ‘Annual contribution of owners of prescribed premises ‘11. The amounts of contributions to be paid by owners of prescribed

5 Fire Service Amendment (No. 1) No. 189, 1993 properties, in relation to the financial year 1 July 1993 to 30 June 1994, are the amounts set out in Schedule 2, for the categories of prescribed properties set out in Schedule 2 and Schedule 3, and determined in the way set out in section 13. ˙ ‘Categories of prescribed properties ‘12. Prescribed properties are categorised into— (a) the fire levy groups specified in Schedule 2; and (b) the classes of urban districts specified in Schedule 3. ˙ ‘Calculation of contribution ‘13.(1) The contribution in relation to a prescribed property is calculated by determining— (a) the fire levy group in Schedule 2 of the property; and (b) the class of urban district set out in Schedule 3 in which the property is located. ‘(2) The contribution payable is the amount in Schedule 2 that applies to the fire levy group and urban district class of the property. ˙ ‘Multiple fire levy groups applying to property ‘14. If the application of section 13 results in the property falling into more than 1 fire levy group, the property is to be taken as being in the fire levy group that will lead to the owner paying the higher or highest contribution for the property. ˙ ‘Repeal ‘15. The order in council made under the Act on 30 May 1991 and published in the Gazette on 1 June 1991 at page 540–2 is repealed. ’. ˙ Replacement of Schedule 1 6. Schedule 1—
